 1                    AMENDMENT TO HOUSE BILL 3162

 2        AMENDMENT NO.     .  Amend House Bill  3162  on  page  2,
 3    line 16 after "50" by inserting "and adding Section 60"; and

 4    on page 6, by inserting the following after line 25:

 5        "(215 ILCS 97/60 new)
 6        Sec.  60.  Notice  requirement  to the Department. In any
 7    case where a health  insurance  issuer  elects  to  uniformly
 8    modify coverage, uniformly terminate coverage, or discontinue
 9    coverage  in a marketplace in accordance with Sections 30 and
10    50 of this Act,  the  issuer  shall  provide  notice  to  the
11    Department    prior   to   notifying   the   plan   sponsors,
12    participants, beneficiaries, and  covered  individuals.   The
13    notice  shall  be sent by certified mail to the Department 90
14    days in advance of any notification of the company's actions.
15    The notice shall include: (i) a complete description  of  the
16    action  to  be taken, (ii) a specific description of the type
17    of coverage affected, (iii) the total number of covered lives
18    affected, (iv) a sample draft of all letters  being  sent  to
19    the plan sponsors and participants, beneficiaries, or covered
20    individuals,  (v)  time  frames  for the actions being taken,
21    (vi) options the plans sponsors, participants, beneficiaries,
22    or covered individuals may have available to them  under  the

 1    federal  Health Insurance Portability and Accountability Act,
 2    and  (vii)  any  other  information  as   required   by   the
 3    Department.".
