 1                    AMENDMENT TO HOUSE BILL 2608

 2        AMENDMENT NO.     .  Amend House Bill 2608,  AS  AMENDED,
 3    in  Section  10,  subsection  (a),  after  the  last  line of
 4    paragraph (10), by inserting the following:
 5             "(11)  The  right  to  confidentiality  of  records.
 6        Homeless  shelters  shall  obtain  a  voluntary   written
 7        release  from  a  homeless person prior to disclosing any
 8        personal  information  regarding  the  homeless   person,
 9        including,  but  not  limited  to,  name, social security
10        number, and birth date, except  in  aggregate  form.  The
11        right   to   confidentiality   of  records  includes  the
12        dissemination of  materials  to  other  agencies,  either
13        private or public. The homeless person shall be given the
14        option   of  whether  to  release  records  via  informed
15        consent, based on guidelines from  the  Office  of  Human
16        Research  Protections, United States Department of Health
17        and Human Services, including:
18                  (A)  the expected  duration  of  the  subject's
19             participation;
20                  (B)  an  explanation  of  whom  to  contact for
21             answers to pertinent questions  about  the  research
22             and  research  subjects' rights, and whom to contact
23             in the event of a  research-related  injury  to  the
24             subject;

 1                  (C)  a    statement   that   participation   in
 2             releasing   records   is   voluntary,   refusal   to
 3             participate will  involve  no  penalty  or  loss  of
 4             benefits to which the subject is otherwise entitled,
 5             and the subject may discontinue participation in the
 6             record  release  at any time without penalty or loss
 7             of  benefits  to  which  the  subject  is  otherwise
 8             entitled;
 9                  (D)  a   description    of    any    reasonably
10             foreseeable risks or discomforts to the subject; and
11                  (E)  a statement describing the extent, if any,
12             to  which confidentiality of records identifying the
13             subject will be maintained.".
