 1                    AMENDMENT TO HOUSE BILL 1567

 2        AMENDMENT NO.     .  Amend House Bill 1567  by  replacing
 3    the title with the following:
 4        "AN ACT concerning professional regulation.";and

 5    by  replacing  everything  after the enacting clause with the
 6    following:

 7        "Section 5.  The Barber, Cosmetology, Esthetics, and Nail
 8    Technology Act of 1985 is amended by  changing  Sections  2-2
 9    and 3-2 as follows:

10        (225 ILCS 410/2-2) (from Ch. 111, par. 1702-2)
11        (Section scheduled to be repealed on January 1, 2006)
12        Sec. 2-2. Licensure as a barber; qualifications.
13        (1)  A  person  is  qualified  to  receive a license as a
14    barber if  that  person  has  applied  in  writing  on  forms
15    prescribed  by  the  Department,  has paid the required fees,
16    and:
17             a.  Is at least 16 years of age; and
18             b.  Has a certificate of graduation  from  a  school
19        providing   secondary   education,   or   the  recognized
20        equivalent of such a  certificate,  or  persons  who  are
21        beyond the age of compulsory school attendance; and

 1             c.  Has   graduated   from  a  school  of  barbering
 2        approved by the Department, having completed a  total  of
 3        1500  hours  in  the  study of barbering extending over a
 4        period of not less than 9 months nor more than  3  years.
 5        A  school of barbering may, at its discretion, consistent
 6        with the rules of the Department, accept up to 500  hours
 7        of   cosmetology   school   training   at   a  recognized
 8        cosmetology  school   toward   the   1500   hour   course
 9        requirement of barbering.  Time spent in such study under
10        the  laws  of  another  state  or territory of the United
11        States or of a  foreign  country  or  province  shall  be
12        credited  toward  the  period  of  study  required by the
13        provisions of this paragraph; and
14             d.  Has passed an examination caused to be conducted
15        by the Department or its designated  testing  service  to
16        determine fitness to receive a license as a barber; and
17             e.  Has met all other requirements of this Act.
18        (2)  If  the  applicant applies for a license as a barber
19    on September 2, 2003 or September 3, 2003, the Department may
20    accept a verified 10 years  of  experience  as  a  barber  or
21    barber's  apprentice  before  July  1,  2003  in  lieu of the
22    requirements in items c and  d  of  subsection  (1)  of  this
23    Section.

27        Sec. 3-2. Licensure; qualifications.
28        (1)  A  person  is  qualified  to  receive a license as a
29    cosmetologist who has filed an application on forms  provided
30    by the Department, pays the required fees, and:
31             a.  Is at least l6 years of age; and
32             b.  Has  graduated  from  an eighth grade elementary
33        school, or its equivalent; and

 1             c.  Has  graduated  from  a  school  of  cosmetology
 2        approved by the Department, having completed a  total  of
 3        l500  hours  in the study of cosmetology extending over a
 4        period of  not  less  than  8  months  nor  more  than  7
 5        consecutive  years.   A school of cosmetology may, at its
 6        discretion, consistent with  the rules of the Department,
 7        accept up to 500 hours of barber  school  training  at  a
 8        recognized  barber  school  toward  the l500 hour program
 9        requirement of cosmetology.  Time  spent  in  such  study
10        under  the  laws  of  another  state  or territory of the
11        United States or of a foreign country or  province  shall
12        be  credited   toward the period of study required by the
13        provisions of this paragraph; and
14             d.  Has passed  an  examination  authorized  by  the
15        Department to determine fitness to receive a license as a
16        cosmetologist. The requirements for remedial training set
17        forth  in  Section 3-6 of this Act may be waived in whole
18        or in part by the Department upon proof to the Department
19        that the applicant has demonstrated competence  to  again
20        sit for the examination.  The Department shall promulgate
21        rules   establishing   the   standards   by   which  such
22        determination shall be made; and
23             e.  Has met any other requirements of this Act.
24        (2)  If  the  applicant  applies  for  a  license  as   a
25    cosmetologist  on September 1, 2000 or September 2, 2000, the
26    Department may accept a  verified  10  years  of  cosmetology
27    experience,  which  may  include esthetics or nail technology
28    experience, before July 1, 2000 in lieu of  the  requirements
29    in items c and d of subsection (1) of this Section.
30        (3)  If   the  applicant  applies  for  a  license  as  a
31    cosmetologist on September 2, 2003 or September 3, 2003,  the
32    Department  may issue a license to the applicant if he or she
33    has met all of the requirements of  subsection  (1)  of  this
34    Section except item d.

 2        Section  99.  Effective date.  This Act takes effect upon
 3    becoming law.".
