 1                     AMENDMENT TO HOUSE BILL 761

 2        AMENDMENT NO.     .  Amend House Bill  761  by  replacing
 3    everything after the enacting clause with the following:

 4        "Section   5.  The  School  Code  is  amended  by  adding
 5    Sections 10-20.37 and 34-18.26 as follows:

 6        (105 ILCS 5/10-20.37 new)
 7        Sec.   10-20.37.  Provision   of   student    information
 8    prohibited.   A  school  district may not provide a student's
 9    name, address,  telephone  number,  social  security  number,
10    e-mail  address, or other personal identifying information to
11    a business organization or financial institution that  issues
12    credit or debit cards.

13        (105 ILCS 5/34-18.26 new)
14        Sec.    34-18.26.  Provision   of   student   information
15    prohibited.  The school district may not provide a  student's
16    name,  address,  telephone  number,  social  security number,
17    e-mail address, or other personal identifying information  to
18    a  business organization or financial institution that issues
19    credit or debit cards.

20        Section 10.  The University of Illinois Act is amended by

 1    adding Section 30 as follows:

 2        (110 ILCS 305/30 new)
 3        Sec. 30.  Provision of  student  information  prohibited.
 4    The  University  may  not  provide a student's name, address,
 5    telephone number, social security number, e-mail address,  or
 6    other   personal   identifying   information  to  a  business
 7    organization or financial institution that issues  credit  or
 8    debit cards, unless the student is 21 years of age or older.

 9        Section  15.  The Southern Illinois University Management
10    Act is amended by adding Section 15 as follows:

11        (110 ILCS 520/15 new)
12        Sec. 15.  Provision of  student  information  prohibited.
13    The  University  may  not  provide a student's name, address,
14    telephone number, social security number, e-mail address,  or
15    other   personal   identifying   information  to  a  business
16    organization or financial institution that issues  credit  or
17    debit cards, unless the student is 21 years of age or older.

18        Section  20.  The Chicago State University Law is amended
19    by adding Section 5-120 as follows:

20        (110 ILCS 660/5-120 new)
21        Sec. 5-120.  Provision of student information prohibited.
22    The University may not provide  a  student's  name,  address,
23    telephone  number, social security number, e-mail address, or
24    other  personal  identifying  information   to   a   business
25    organization  or  financial institution that issues credit or
26    debit cards, unless the student is 21 years of age or older.

27        Section  25.  The  Eastern  Illinois  University  Law  is
28    amended by adding Section 10-120 as follows:

 2        Sec.   10-120.  Provision    of    student    information
 3    prohibited.  The University may not provide a student's name,
 4    address,  telephone  number,  social  security number, e-mail
 5    address, or  other  personal  identifying  information  to  a
 6    business  organization  or  financial institution that issues
 7    credit or debit cards, unless the student is 21 years of  age
 8    or older.

 9        Section   30.  The  Governors  State  University  Law  is
10    amended by adding Section 15-120 as follows:

11        (110 ILCS 670/15-120 new)
12        Sec.   15-120.  Provision    of    student    information
13    prohibited.  The University may not provide a student's name,
14    address,  telephone  number,  social  security number, e-mail
15    address, or  other  personal  identifying  information  to  a
16    business  organization  or  financial institution that issues
17    credit or debit cards, unless the student is 21 years of  age
18    or older.

19        Section 35.  The Illinois State University Law is amended
20    by adding Section 20-125 as follows:

21        (110 ILCS 675/20-125 new)
22        Sec.    20-125.  Provision    of    student   information
23    prohibited.  The University may not provide a student's name,
24    address, telephone number,  social  security  number,  e-mail
25    address,  or  other  personal  identifying  information  to a
26    business organization or financial  institution  that  issues
27    credit  or debit cards, unless the student is 21 years of age
28    or older.

29        Section 40.  The Northeastern Illinois University Law  is

 2        (110 ILCS 680/25-120 new)
 3        Sec.    25-120.  Provision    of    student   information
 4    prohibited.  The University may not provide a student's name,
 5    address, telephone number,  social  security  number,  e-mail
 6    address,  or  other  personal  identifying  information  to a
 7    business organization or financial  institution  that  issues
 8    credit  or debit cards, unless the student is 21 years of age
 9    or older.

10        Section 45.  The  Northern  Illinois  University  Law  is
11    amended by adding Section 30-130 as follows:

12        (110 ILCS 685/30-130 new)
13        Sec.    30-130.  Provision    of    student   information
14    prohibited.  The University may not provide a student's name,
15    address, telephone number,  social  security  number,  e-mail
16    address,  or  other  personal  identifying  information  to a
17    business organization or financial  institution  that  issues
18    credit  or debit cards, unless the student is 21 years of age
19    or older.

20        Section  50.  The  Western  Illinois  University  Law  is
21    amended by adding Section 35-125 as follows:

22        (110 ILCS 690/35-125 new)
23        Sec.   35-125.  Provision    of    student    information
24    prohibited.  The University may not provide a student's name,
25    address,  telephone  number,  social  security number, e-mail
26    address, or  other  personal  identifying  information  to  a
27    business  organization  or  financial institution that issues
28    credit or debit cards, unless the student is 21 years of  age
29    or older.

 1        Section  55.  The Public Community College Act is amended
 2    by adding Section 3-60 as follows:

 3        (110 ILCS 805/3-60 new)
 4        Sec. 3-60.  Provision of student information  prohibited.
 5    A  community  college  may  not  provide  a  student's  name,
 6    address,  telephone  number,  social  security number, e-mail
 7    address, or  other  personal  identifying  information  to  a
 8    business  organization  or  financial institution that issues
 9    credit or debit cards, unless the student is 21 years of  age
10    or older.

11        Section  99.   Effective  date.  This Act takes effect on
12    July 1, 2003.".
