1 AN ACT concerning the Metropolitan Water Reclamation
2 District.
3 Be it enacted by the People of the State of Illinois,
4 represented in the General Assembly:
5 Section 5. The Metropolitan Water Reclamation District
6 Act is amended by changing Section 4.2 as follows:
7 (70 ILCS 2605/4.2) (from Ch. 42, par. 323.2)
8 Sec. 4.2. There is hereby created and established a civil
9 service board to consist of 3 persons to be selected in the
10 manner following:
11 The governing authority or body of the sanitary district,
12 hereinafter called the trustees, shall on or before January
13 31, 1952 appoint a civil service board of 3 members, all of
14 whom shall be persons who are not trustees and not more than
15 2 of whom shall be affiliated with the same political party.
16 Each member shall have been a qualified elector of the
17 sanitary district for at least 5 years immediately prior to
18 his or her appointment and shall believe firmly in the merit
19 system of government. No person shall be appointed to the
20 civil service board who has held an elective public office or
21 a position in a political party within the 2 years
22 immediately prior to his or her appointment. No member of
23 the board shall be a member of a committee in any partisan
24 political club or organization, or shall hold or be a
25 candidate for any elective public office.
26 Of the members so appointed, one shall be appointed for a
27 term of 2 years, one for a term of 4 years and one for a term
28 of 6 years beginning February 1, 1952. All subsequent
29 appointments shall be for 6 year terms beginning February 1
30 of the year in which the antecedent term expires. In the
31 event a vacancy occurs from any cause in the office of any

1 member, the unexpired portion of the term shall be filled by
2 appointment within 60 days by the trustees. The board shall
3 elect from its members a chairman, vice-chairman and
4 secretary. Each shall serve for a term of 2 years or until a
5 successor is elected. Each member of the board shall receive
6 a salary of $20,000$15,000 per annum, except the Chairman,
7 who shall receive a salary of $22,500$17,500 per annum. Two
8 members of the civil service board shall constitute a quorum,
9 but in no instance shall the board have authority or exercise
10 responsibility if 60 days after a vacancy exists on the board
11 it has not been filled by appointment.
12 No member of the civil service board shall be removed
13 except for palpable incompetence or malfeasance in office
14 upon written charges filed by or at the direction of the
15 trustees and heard before the trustees sitting as the board
16 of hearings herein provided for.
17 The board of hearings shall hear and determine the
18 charges and its findings shall be final. If the charges are
19 sustained, the member of the civil service board so charged
20 shall be forthwith removed from office by the board of
21 hearings and the trustees shall thereupon proceed within 30
22 days to fill the vacancy created by that removal. In all
23 proceedings provided for in this Section, the board of
24 hearings and each member thereof shall have power to
25 administer oaths and to compel by subpoena the attendance and
26 testimony of witnesses and the production of books and
27 papers.
