 1                     AMENDMENT TO HOUSE BILL 121

 2        AMENDMENT NO.     .  Amend House Bill 121, AS AMENDED, by
 3    replacing everything  after  the  enacting  clause  with  the
 4    following:

 5        "Section  5.  The  State  Fire  Marshal Act is amended by
 6    adding Section 2.5 as follows:

 7        (20 ILCS 2905/2.5 new)
 8        Sec. 2.5.  Equipment exchange  program.  The  Office  may
 9    create   an  equipment  exchange  program  under  which  fire
10    departments, fire protection  districts,  and  township  fire
11    departments can donate equipment to each other.
12        A  fire department, fire protection district, or township
13    fire department that donates  fire  protection  equipment  to
14    another   fire   department,  fire  protection  district,  or
15    township fire department under this Section is not liable for
16    any damage or injury caused by the  donated  fire  protection
17    equipment,  except for damage or injury caused by the donor's
18    willful and wanton misconduct,  if  the  donor  discloses  in
19    writing  to  the  recipient  at  the time of the donation any
20    known damage to or deficiencies in the equipment.
21        This Section does not relieve any fire  department,  fire
22    protection   district,   or  township  fire  department  from

 1    liability, unless otherwise provided by law, for  any  damage
 2    or  injury  caused  by donated fire protection equipment that
 3    was received through the equipment exchange program.

 4        Section 99. Effective date. This Act  takes  effect  upon
 5    becoming law.".
