1    AN ACT concerning regulation.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 2. The Wireless Emergency Telephone Safety Act is
5amended by changing Section 85 as follows:
 
6    (50 ILCS 751/85)
7    (Section scheduled to be repealed on July 1, 2014)
8    Sec. 85. 9-1-1 Services Advisory Board. There is hereby
9created the 9-1-1 Services Advisory Board. The Board shall work
10with the Commission to determine the 9-1-1 costs necessary for
11every 9-1-1 system to adequately function and shall submit, by
12May February 1, 2014, recommendations on whether there is a
13need to consolidate 9-1-1 functions to the General Assembly.
14The Board shall consist of 11 members appointed by the Governor
15as follows:
16        (1) the Executive Director of the Illinois Commerce
17    Commission, or his or her designee;
18        (2) one member representing the Illinois chapter of the
19    National Emergency Number Association;
20        (3) one member representing the Illinois chapter of the
21    Association of Public-Safety Communications Officials;
22        (4) one member representing a county 9-1-1 system from
23    a county with a population of 50,000 or less;

1        (5) one member representing a county 9-1-1 system from
2    a county with a population between 50,000 and 250,000;
3        (6) one member representing a county 9-1-1 system from
4    a county with a population of 250,000 or more;
5        (7) one member representing an incumbent local
6    exchange 9-1-1 system provider;
7        (8) one member representing a non-incumbent local
8    exchange 9-1-1 system provider;
9        (9) one member representing a large wireless carrier;
10        (10) one member representing a small wireless carrier;
11    and
12        (11) one member representing the Illinois
13    Telecommunications Association.
14    The Board is abolished on July 1, 2014.

16    Section 5. The Public Utilities Act is amended by changing
17Section 2-203 as follows:
 
18    (220 ILCS 5/2-203)
19    (Section scheduled to be repealed on January 1, 2014)
20    Sec. 2-203. Public Utility Fund base maintenance
21contribution. Each electric utility as defined in Section
2216-102 of this Act providing service to more than 12,500
23customers in this State on January 1, 1995 shall contribute
24annually a pro rata share of a total amount of $5,500,000 based

1upon the number of kilowatt-hours delivered to retail customers
2within this State by each such electric utility in the 12
3months preceding the year of contribution. On or before May 1
4of each year, the Illinois Commerce Commission shall determine
5and notify the Illinois Department of Revenue of the pro rata
6share owed by each electric utility based upon information
7supplied annually to the Commission. On or before June 1 of
8each year, the Department of Revenue shall send written
9notification to each electric utility of the amount of pro rata
10share they owe. These contributions shall be remitted to the
11Department of Revenue no earlier than July 1 and no later than
12July 31 of each year the contribution is due on a return
13prescribed and furnished by the Department of Revenue showing
14such information as the Department of Revenue may reasonably
15require. The Department of Revenue shall place the funds
16remitted under this Section in the Public Utility Fund in the
17State treasury. The funds received pursuant to this Section
18shall be subject to appropriation by the General Assembly. If
19an electric utility does not remit its pro rata share to the
20Department of Revenue, the Department of Revenue must inform
21the Illinois Commerce Commission of such failure. The Illinois
22Commerce Commission may then revoke the certification of that
23electric utility. This Section is repealed on April 1, 2015
24January 1, 2014.
