SYNOPSIS AS INTRODUCED:
 
50 ILCS 205/20 new
30 ILCS 805/8.38 new

    Amends the Local Records Act. Provides that every park district that maintains an Internet website must post to its website a list of total compensation paid to each employee and whether that employee is an elected official. Requires park districts without a website to make the same information available to the public in its main office. Limits home rule powers. Amends the State Mandates Act to require implementation without reimbursement.

1    AN ACT concerning local government.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Local Records Act is amended by adding
5Section 20 as follows:
 
6    (50 ILCS 205/20 new)
7    Sec. 20. Park district posting requirements.
8    (a) Every park district that maintains an Internet website
9shall, within 90 days of the effective date of this amendatory
10Act of the 98th General Assembly, post to its website for the
11current calendar year a detailed list of the total compensation
12paid to each employee including wages, salary, overtime, and
13benefits, including health, dental, life, and pension, and
14whether that employee is an elected official.
15    (b) A park district that does not maintain an Internet
16website shall, within 90 days of the effective date of this
17amendatory Act of the 98th General Assembly, post in its main
18office for the current calendar year a detailed list of the
19total compensation paid to each employee including wages,
20salary, overtime, and benefits, including health, dental,
21life, and pension, and whether that employee is an elected
22official.
23    (c) The information required to be posted on a website

1under this Section must be easily accessible from the park
2district's home page and searchable. The information required
3to be posted in the park district's main office under this
4Section must be easily accessible to the public.
5    (d) The postings required by this Section are in addition
6to any other posting requirements required by law or ordinance.
7    (e) No home rule unit may adopt posting requirements that
8are less restrictive than this Section. This Section is a
9limitation under subsection (i) of Section 6 of Article VII of
10the Illinois Constitution on the concurrent exercise by home
11rule units of powers and functions exercised by the State.
 
12    Section 90. The State Mandates Act is amended by adding
13Section 8.38 as follows:
 
14    (30 ILCS 805/8.38 new)
15    Sec. 8.38. Exempt mandate. Notwithstanding Sections 6 and 8
16of this Act, no reimbursement by the State is required for the
17implementation of any mandate created by this amendatory Act of
18the 98th General Assembly.
