SYNOPSIS AS INTRODUCED:

    Amends the Illinois Holocaust and Genocide Commission Act. Deletes a provision that a member of the House and the Senate shall advise the Commission. Provides that upon the expiration of the terms of the initial members, the appointing authority shall re-appoint initial members and sets forth the terms of those re-appointments. Provides that a representative under the Act must be an officer or employee of the State agency that employs the ex officio member or an individual with demonstrated expertise in the subject matter of the ex officio member's State agency. Effective immediately.

1    AN ACT concerning State government.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Illinois Holocaust and Genocide Commission
5Act is amended by changing Sections 10, 20, and 30 as follows:
 
6    (20 ILCS 5010/10)
7    (Section scheduled to be repealed on January 1, 2021)
8    Sec. 10. Composition of the Commission.
9    (a) The Commission is composed of 18 members as follows:
10        (1) Public 15 public members appointed by the Governor;
11    and
12        (2) 3 ex officio members as follows:
13            (A) the State Superintendent of Education;
14            (B) the Executive Director of the Board of Higher
15        Education; and
16            (C) the Director of Veterans' Affairs.
17    (b) The President and Minority Leader of the Senate shall
18each designate a member of the Senate and the Speaker and
19Minority Leader of the House of Representatives shall each
20designate a member of the House to advise the Commission.

2    Sec. 20. Ex officio members; eligibility; designation of
3representative.
4    (a) An ex officio member of the Commission vacates the
5person's position on the Commission if the person ceases to
6hold the position that qualifies the person for service on the
7Commission.
8    (b) An ex officio member may designate a representative to
9serve on the Commission in the member's absence. A
10representative designated under this subsection must be an
11officer or employee of the State agency that employs the ex
12officio member or an individual with demonstrated expertise in
13the subject matter of the ex officio member's State agency.

17    Sec. 30. Term of public member.
18    (a) A public member of the Commission serves a term of 4
19years, except that the terms of the initial members shall
20expire on February 1, 2015. Following the expiration of the
21terms of the initial members of the Commission, the appointing
22authority shall re-appoint initial members as follows:
23        (1) five members to terms that expire February 1, 2016;
24        (2) five members to terms that expire February 1, 2017;

1        (3) five members to terms that expire February 1, 2018.
2Notwithstanding subsection (c) of this Section, initial
3members re-appointed to terms that expire on February 1, 2016
4or February 1, 2017 may be appointed to a 4-year term following
5expiration of their re-appointment.
6    (b) A public member is eligible for reappointment to
7another term or part of a term.
8    (c) A public member may not serve more than 2 consecutive
9full terms. For purposes of this prohibition, a member is
10considered to have served a full term only if the member has
11served more than half of a 4-year the term.

13    Section 99. Effective date. This Act takes effect upon
14becoming law.
