SYNOPSIS AS INTRODUCED:
 
815 ILCS 505/2NN

    Amends the Consumer Fraud and Deceptive Business Practices Act. Provides that it is an unlawful practice to disclose any part of the cardholder's name on a credit card or debit card receipt.

1    AN ACT concerning business.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Consumer Fraud and Deceptive Business
5Practices Act is amended by changing Section 2NN as follows:
 
6    (815 ILCS 505/2NN)
7    Sec. 2NN. Receipts; credit card and debit card account
8numbers; cardholder name.
9    (a) Definitions. As used in this Section:
10    "Cardholder" has the meaning ascribed to it in Section
1117-0.5 of the Criminal Code of 2012.
12    "Credit card" has the meaning ascribed to it in Section
1317-0.5 of the Criminal Code of 2012.
14    "Debit card" has the meaning ascribed to it in Section
1517-0.5 of the Criminal Code of 2012.
16    "Issuer" has the meaning ascribed to it in Section 17-0.5
17of the Criminal Code of 2012.
18    "Person" has the meaning ascribed to it in Section 17-0.5
19of the Criminal Code of 2012.
20    "Provider" means a person who furnishes money, goods,
21services, or anything else of value upon presentation, whether
22physically, in writing, verbally, electronically, or
23otherwise, of a credit card or debit card by the cardholder, or

1any agent or employee of that person.
2    (b) Except as otherwise provided in this Section, no
3provider may print or otherwise produce or reproduce or permit
4the printing or other production or reproduction of the
5following: (i) any part of the credit card or debit card
6account number, other than the last 4 digits or other
7characters, (ii) the credit card or debit card expiration date,
8and (iii) any part of the cardholder's name on any receipt
9provided or made available to the cardholder.
10    (c) This Section does not apply to a credit card or debit
11card transaction in which the sole means available to the
12provider of recording the credit card or debit card account
13number is by handwriting or by imprint of the card.
14    (d) This Section does not apply to receipts issued for
15transactions on the electronic benefits transfer card system in
16accordance with 7 CFR 274.12(g)(3).
17    (e) A violation of this Section constitutes an unlawful
18practice within the meaning of this Act.
19    (f) This Section is operative on January 1, 2005.
