SYNOPSIS AS INTRODUCED:
 
30 ILCS 105/5.826 new
625 ILCS 5/3-699 new

    Amends the Illinois Vehicle Code. Authorizes the Secretary of State to issue Christopher Wheatley Memorial License Plates. Creates the Christopher Wheatley Memorial Foundation Fund and authorizes payments, subject to appropriation by the General Assembly and distribution by the Secretary of State, as grants to the Christopher D. Wheatley Memorial Foundation.

1    AN ACT concerning transportation.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The State Finance Act is amended by adding
5Section 5.826 as follows:
 
6    (30 ILCS 105/5.826 new)
7    Sec. 5.826. The Christopher Wheatley Memorial Foundation
8Fund.
 
9    Section 10. The Illinois Vehicle Code is amended by adding
10Section 3-699 as follows:
 
11    (625 ILCS 5/3-699 new)
12    Sec. 3-699. Christopher Wheatley Memorial License Plates.
13    (a) The Secretary, upon receipt of all applicable fees and
14applications made in the form prescribed by the Secretary, may
15issue special registration plates designated as Christopher
16Wheatley Memorial license plates. The special plates issued
17under this Section shall be affixed only to passenger vehicles
18of the first division and motor vehicles of the second division
19weighing not more than 8,000 pounds. Plates issued under this
20Section shall expire according to the multi-year procedure
21established by Section 3-414.1 of this Code.

1    (b) The design and color of the plates is wholly within the
2discretion of the Secretary of State. Appropriate
3documentation, as determined by the Secretary, shall accompany
4the application. The Secretary, in his or her discretion, may
5allow the plates to be issued as vanity or personalized plates
6under Section 3-405.1 of this Code. The Secretary shall
7prescribe stickers or decals as provided under Section 3-412 of
8this Code.
9    (c) An applicant for the special plate shall be charged a
10$40 fee for original issuance in addition to the appropriate
11registration fee. Of this fee, $25 shall be deposited into the
12Christopher Wheatley Memorial Foundation Fund and $15 shall be
13deposited into the Secretary of State Special License Plate
14Fund, to be used by the Secretary to help defray the
15administrative processing costs.
16    For each registration renewal period, a $25 fee, in
17addition to the appropriate registration fee, shall be charged.
18Of this fee, $23 shall be deposited into the Christopher
19Wheatley Memorial Foundation Fund and $2 shall be deposited
20into the Secretary of State Special License Plate Fund.
21    (d) The Christopher Wheatley Memorial Foundation Fund is
22created as a special fund in the State treasury. All money in
23the Christopher Wheatley Memorial Foundation Fund shall be
24paid, subject to appropriation by the General Assembly and
25distribution by the Secretary, as grants to the Christopher D.
26Wheatley Memorial Foundation for the funding of scholarships.
