SYNOPSIS AS INTRODUCED:
 
New Act

    Creates the Fire and Smoke Damper Inspection Act. Provides that commercial structures that require fire and smoke damper installations shall have fire and smoke dampers inspected and tested within one year after installation, commercial structures with fire and smoke dampers shall have fire and smoke dampers inspected and tested at least once every 4 years, and hospitals with fire and smoke dampers shall have fire and smoke dampers inspected and tested at least once every 6 years. Provides that inspections shall certify compliance with specified authorities. Provides that inspections and testing shall be conducted by individuals certified by the International Certification Board and American National Standards Institute. Provides specified requirements for fire and smoke damper inspections. Effective immediately.

1    AN ACT concerning safety.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 1. Short title. This Act may be cited as the Fire
5and Smoke Damper Inspection Act.
 
6    Section 5. Inspection frequency. Commercial structures
7that require fire and smoke damper installations shall have the
8installed fire and smoke dampers inspected and tested within
9one year after installation. Commercial structures with fire
10and smoke dampers shall have fire and smoke dampers inspected
11and tested at least once every 4 years. Hospitals with fire and
12smoke dampers shall have fire and smoke dampers inspected and
13tested at least once every 6 years. Inspections shall certify
14compliance with Section 717 of the 2012 International Building
15Code. Inspections and testing shall be conducted by individuals
16certified by the International Certification Board and
17American National Standards Institute.
 
18    Section 10. Inspection requirements. Fire and smoke damper
19inspections and testing shall comply with each of the
20following:
21        (1) Inspections shall be conducted by individuals
22    certified by the International Certification Board and

1    American National Standards Institute.
2        (2) Inspectors shall certify that the all fire and
3    smoke dampers inspected comply with Section 717 of the 2012
4    International Building Code.
5        (3) All tests shall be completed safely by personnel
6    wearing protective equipment.
7        (4) Unobstructed access to fire and smoke dampers shall
8    be verified and corrected as required.
9        (5) Fire and smoke dampers shall be actuated and cycled
10    as a part of the associated smoke detector testing in
11    accordance with the National Fire Alarm and Signaling Code
12    of the National Fire Protection Association.
13        (6) If fire and smoke dampers have a fusible link, the
14    link shall be removed for testing to ensure full closure
15    and lock-in-place, if so equipped.
16        (7) The operation test of fire and smoke dampers shall
17    verify that there is no interference concerning the fire
18    and smoke damper due to rusted, bent, misaligned, or
19    damaged frames or blades or defective hinges or parts.
20        (8) Fire and smoke damper frames shall not be
21    penetrated by any foreign objects that would affect fire
22    and smoke damper operations.
23        (9) Fire and smoke dampers shall not be blocked from
24    closure in any way.
25        (10) Fusible links, if applicable, shall be
26    reinstalled after the completion of testing.

1        (11) If fusible links are damaged or painted, they
2    shall be replaced with a link of the same size,
3    temperature, and load rating.
4        (12) All inspections and testing shall include
5    documentation stating the location of the fire and smoke
6    damper, the date of the inspection, the name of the
7    inspector, and any deficiencies discovered. The
8    documentation shall have a designated space to indicate
9    when and how the deficiencies, if any, were corrected. All
10    documentation shall be maintained and made available for
11    review at the request of the unit of local government
12    having jurisdiction over the building receiving the
13    inspection and testing.
 
14    Section 99. Effective date. This Act takes effect upon
15becoming law.
