SYNOPSIS AS INTRODUCED:
 
705 ILCS 405/5-125

    Amends the Juvenile Court Act of 1987. Makes a technical change in a Section concerning prosecution of a traffic, boating, or fish and game law or ordinance violation committed by a minor.

1    AN ACT concerning courts.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Juvenile Court Act of 1987 is amended by
5changing Section 5-125 as follows:
 
6    (705 ILCS 405/5-125)
7    Sec. 5-125. Concurrent jurisdiction. Any minor alleged to
8have violated a traffic, boating, or fish and and game law, or
9a municipal or county ordinance, may be prosecuted for the
10violation and if found guilty punished under any statute or
11ordinance relating to the violation, without reference to the
12procedures set out in this Article, except that:
13        (1) any detention, must be in compliance with this
14    Article; and
15        (2) the confidentiality of records provisions in Part 9
16    of this Article shall apply to any law enforcement and
17    court records relating to prosecution of a minor under 18
18    years of age for a municipal or county ordinance violation
19    or a violation of subsection (a) of Section 4 of the
20    Cannabis Control Act or subsection (c) of Section 3.5 of
21    the Drug Paraphernalia Control Act; except that these
22    confidentiality provisions shall not apply to or affect any
23    proceeding to adjudicate the violation.

1    For the purpose of this Section, "traffic violation" shall
2include a violation of Section 9-3 of the Criminal Code of 1961
3or the Criminal Code of 2012 relating to the offense of
4reckless homicide, Section 11-501 of the Illinois Vehicle Code,
5or any similar county or municipal ordinance.
