1    AN ACT concerning transportation.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 1. Short Title. This Act may be cited as the
5Statewide Relocation Towing Licensure Commission Act of 2018.
 
6    Section 5. The Statewide Relocation Towing Licensure
7Commission.
8    (a) The Statewide Relocation Towing Licensure Commission
9is created.
10    (b) Within 60 days after the effective date of this Act,
11the members of the Commission shall be appointed with the
12following members:
13        (1) one member of the General Assembly, appointed by
14    the President of the Senate;
15        (2) one member of the General Assembly, appointed by
16    the Minority Leader of the Senate;
17        (3) one member of the General Assembly, appointed by
18    the Speaker of the House of Representatives;
19        (4) one member of the General Assembly, appointed by
20    the Minority Leader of the House of Representatives;
21        (5) the Mayor of the City of Chicago, or his or her
22    designee;
23        (6) the Secretary of Transportation, or his or her

1    designee;
2        (7) the Director of State Police, or his or her
3    designee;
4        (8) two members of the public who represent the towing
5    industry, appointed by the President of the Professional
6    Towing and Recovery Operators of Illinois;
7        (9) two members of the public who represent the
8    property casualty insurance industry, appointed by the
9    Executive Director of the Illinois Insurance Association;
10        (10) the President of the Illinois Municipal League, or
11    his or her designee;
12        (11) the President of the Illinois Sheriffs'
13    Association, or his or her designee;
14        (12) the Cook County State's Attorney, or his or her
15    designee;
16        (13) the Chairman of the Illinois Commerce Commission,
17    or his or her designee;
18        (14) the President of the Northwest Municipal
19    Conference, or his or her designee; and
20        (15) a member knowledgeable in auto financing, and
21    holds a valid license under the Consumer Installment Loan
22    Act, appointed by the Secretary of Financial and
23    Professional Regulation.
24    (c) The members of the Commission shall receive no
25compensation for serving as members of the Commission.
26    (d) The Illinois Commerce Commission shall provide

1administrative and other support to the Commission.
 
2    Section 10. Meetings.
3    (a) Each member of the Commission shall have voting rights
4and all actions and recommendations shall be approved by a
5simple majority vote of the members.
6    (b) The Commission shall meet no less than 3 times before
7the report described in Section 15 is filed.
8    (c) At the initial meeting, the Commission shall elect one
9member as a Chairperson, through a simple majority vote, who
10shall thereafter call any subsequent meetings.
 
11    Section 15. Reporting.
12    (a) No later than December 31, 2019, the Commission shall
13submit a report to the Governor and to the General Assembly,
14which shall include, but is not limited to:
15        (1) an evaluation of the current towing laws in this
16    State;
17        (2) a recommendation for an appropriate towing
18    licensure program for this State;
19        (3) a review of all potential litigation costs for an
20    owner of an impounded vehicle, a towing company, and a
21    county or municipality; and
22        (4) any other matters the Commission deems necessary.
23    (b) The report to the General Assembly shall be filed with
24the Clerk of the House of Representatives and the Secretary of

1the Senate in electronic form only, in the manner that the
2Clerk and the Secretary shall direct.
 
3    Section 20. Repealer. This Act is repealed on January 1,
42020.
 
5    Section 999. Effective date. This Act takes effect upon
6becoming law.
