1    AN ACT concerning State government.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Criminal Identification Act is amended by
5adding Section 3.3 as follows:
 
6    (20 ILCS 2630/3.3 new)
7    Sec. 3.3. Federal Rap Back Service.
8    (a) In this Section:
9    "National criminal history record check" means a check of
10criminal history records entailing the fingerprinting of the
11person and submission of the fingerprints to the United States
12Federal Bureau of Investigation for the purpose of obtaining
13the national criminal history record of the person from the
14Federal Bureau of Investigation.
15    "Rap Back Service" means the system that enables an
16authorized agency or entity to receive ongoing status
17notifications of any criminal history from the Department of
18State Police or the Federal Bureau of Investigation reported on
19a person whose fingerprints are registered in the system, after
20approval and implementation of the system.
21    (b) Agencies and entities in this State authorized by law
22to conduct or obtain national criminal history background
23checks for persons shall be eligible to participate in the

1Federal Rap Back Service administered by the Department of
2State Police. The Department of State Police may submit
3fingerprints to the Federal Bureau of Investigation Rap Back
4Service to be retained in the Federal Bureau of Investigation
5Rap Back Service for the purpose of being searched by future
6submissions to the Federal Bureau of Investigation Rap Back
7Service, including latent fingerprint searches and to collect
8all Federal Rap Back Service fees from eligible agencies and
9entities wishing to participate in the Rap Back Service and
10remit those fees to the Federal Bureau of Investigation.
11    (c) The Department of State Police may adopt any rules
12necessary for implementation of this Section.
