SYNOPSIS AS INTRODUCED:

40 ILCS 5/16-121

from Ch. 108 1/2, par. 16-121

Amends the Downstate Teachers Article of the Illinois Pension Code. Provides that "salary" does not include amounts associated with a vehicle allowance payable to a teacher. Effective immediately.

Be it enacted by the People of the State of Illinois, represented in the General Assembly:

Section 5. The Illinois Pension Code is amended by changing Section 16-121 as follows:

(Text of Section WITHOUT the changes made by P.A. 98-599, which has been held unconstitutional)

Sec. 16-121. Salary. "Salary": The actual compensation received by a teacher during any school year and recognized by the system in accordance with rules of the board. "Salary" does not include amounts associated with a vehicle allowance payable to a teacher. For purposes of this Section, "school year" includes the regular school term plus any additional period for which a teacher is compensated and such compensation is recognized by the rules of the board.

Section 99. Effective date. This Act takes effect upon becoming law.
