1    AN ACT concerning elections.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Election Code is amended by changing Section
51A-45 as follows:
 
6    (10 ILCS 5/1A-45)
7    Sec. 1A-45. Electronic Registration Information Center.
8    (a) The State Board of Elections shall enter into an
9agreement with the Electronic Registration Information Center
10effective no later than January 1, 2016, for the purpose of
11maintaining a statewide voter registration database. The
12Electronic Registration Information Center shall provide the
13exclusive interstate voter registration program for the State
14of Illinois, except as provided in subsection (b-11). The State
15Board of Elections shall comply with the requirements of the
16Electronic Registration Information Center Membership
17Agreement. The State Board of Elections shall require a term in
18the Electronic Registration Information Center Membership
19Agreement that requires the State to share identification
20records contained in the Secretary of State's Driver Services
21Department and Vehicle Services Department, the Department of
22Human Services, the Department of Healthcare and Family
23Services, the Department of Aging, and the Department of

1Employment Security databases (excluding those fields
2unrelated to voter eligibility, such as income or health
3information).
4    (b) The Secretary of State and the Board of Elections shall
5enter into an agreement to permit the Secretary of State to
6provide the State Board of Elections with any information
7required for compliance with the Electronic Registration
8Information Center Membership Agreement. The Secretary of
9State shall deliver this information as frequently as necessary
10for the State Board of Elections to comply with the Electronic
11Registration Information Center Membership Agreement.
12    (b-5) The State Board of Elections and the Department of
13Human Services, the Department of Healthcare and Family
14Services, the Department on Aging, and the Department of
15Employment Security shall enter into an agreement to require
16each department to provide the State Board of Elections with
17any information necessary to transmit member data under the
18Electronic Registration Information Center Membership
19Agreement. The director or secretary, as applicable, of each
20agency shall deliver this information on an annual basis to the
21State Board of Elections pursuant to the agreement between the
22entities.
23    (b-10) The State Board of Elections shall not share
24identification records contained in databases maintained by
25the Secretary of State's Driver Services Department and Vehicle
26Services Department, the Department of Human Services, the

1Department of Healthcare and Family Services, the Department of
2Aging, the Department of Employment Security, or any other
3State database containing identification records with any
4interstate voter registration program other than the
5Electronic Registration Information Center, except as provided
6in subsection (b-11).
7    (b-11) The State Board of Elections may enter into an
8exclusive voter data sharing agreement with a state that: (1)
9borders Illinois, and (2) does not participate in the
10Electronic Registration Information Center.
11    (c) Any communication required to be delivered to a
12registrant or potential registrant pursuant to the Electronic
13Registration Information Center Membership Agreement shall
14include at least the following message:
15        "Our records show people at this address may not be
16    registered to vote at this address, but you may be eligible
17    to register to vote or re-register to vote at this address.
18    If you are a U.S. Citizen, a resident of Illinois, and will
19    be 18 years old or older before the next general election
20    in November, you are qualified to vote.
21        We invite you to check your registration online at
22    (enter URL) or register to vote online at (enter URL), by
23    requesting a mail-in voter registration form by (enter
24    instructions for requesting a mail-in voter registration
25    form), or visiting the (name of election authority) office
26    at (address of election authority)."

1    The words "register to vote online at (enter URL)" shall be
2bolded and of a distinct nature from the other words in the
3message required by this subsection (c).
4    (d) Any communication required to be delivered to a
5potential registrant that has been identified by the Electronic
6Registration Information Center as eligible to vote but who is
7not registered to vote in Illinois shall be prepared and
8disseminated at the direction of the State Board of Elections.
9All other communications with potential registrants or
10re-registrants pursuant to the Electronic Registration
11Information Center Membership Agreement shall be prepared and
12disseminated at the direction of the appropriate election
13authority.
14    (e) The Executive Director of the State Board of Elections
15or his or her designee shall serve as the Member Representative
16to the Electronic Registration Information Center.
17    (f) The State Board of Elections may adopt any rules
18necessary to enforce this Section or comply with the Electronic
19Registration Information Center Membership Agreement.

21    Section 90. The State Mandates Act is amended by adding
22Section 8.42 as follows:
 
23    (30 ILCS 805/8.42 new)
24    Sec. 8.42. Exempt mandate. Notwithstanding Sections 6 and 8

1of this Act, no reimbursement by the State is required for the
2implementation of any mandate created by this amendatory Act of
3the 100th General Assembly.
 
4    Section 99. Effective date. This Act takes effect upon
5becoming law.
