SYNOPSIS AS INTRODUCED:
 
210 ILCS 50/3.88 new

    Amends the Emergency Medical Services (EMS) Systems Act. Provides that a volunteer emergency medical services team or volunteer rescue squad providing ambulance services that is licensed by the Department of Public Health to provide emergency and non-emergency medical services under the Act may not be required to transfer an individual that is being provided with ambulance services to a private vehicle service provider except in certain circumstances. Provides that a volunteer emergency medical services team or volunteer rescue squad that is licensed by the Department to provide emergency and non-emergency medical services under the Act may not be required to pay to a private vehicle service provider for ambulance services more than the volunteer emergency medical services team or volunteer rescue squad collects for ambulance services under the State's Medical Assistance Program as provided in specified provisions of the Illinois Public Aid Code, or is reimbursed by a private insurer for providing ambulance services.

1    AN ACT concerning regulation.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Emergency Medical Services (EMS) Systems Act
5is amended by adding Section 3.88 as follows:
 
6    (210 ILCS 50/3.88 new)
7    Sec. 3.88. Volunteer emergency medical services teams;
8volunteer rescue squads. A volunteer emergency medical
9services team or volunteer rescue squad providing ambulance
10services that is licensed by the Department to provide
11emergency and non-emergency medical services under this Act may
12not be required to transfer an individual that is being
13provided with ambulance services to a private vehicle service
14provider unless:
15        (1) the individual being transported requires care,
16    including, but not limited to, advanced life support
17    services, that the volunteer emergency medical services
18    team or volunteer rescue squad is unable to provide; or
19        (2) the volunteer emergency medical services team or
20    volunteer rescue squad is not reasonably able to complete
21    the transport due to unforeseen circumstances including,
22    but not limited to, an equipment failure, motor vehicle
23    accident, or motor vehicle malfunction.

3emergency and non-emergency medical services under this Act may
4not be required to pay to a private vehicle service provider
5for ambulance services more than the volunteer emergency
6medical services team or volunteer rescue squad (1) collects
7for ambulance services under the State's Medical Assistance
8Program as provided in Section 5-4.2 of the Illinois Public Aid
9Code, or (2) is reimbursed by a private insurer for providing
10ambulance services.
