1    AN ACT concerning fish.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Fish and Aquatic Life Code is amended by
5changing Section 15-32 as follows:
 
6    (515 ILCS 5/15-32)  (from Ch. 56, par. 15-32)
7    Sec. 15-32. Lake Michigan Yellow perch and bloater chub;
8commercial licenses.
9    (a) The Department may shall issue a maximum of 5
10commercial licenses for taking from the Illinois waters of Lake
11Michigan yellow perch, and bloater chub, and other commercial
12fish species designated by Department rule. Five licenses shall
13be issued for the fishing year that began April 1, 1992, and
14the Department shall issue licenses from time to time so that 5
15valid licenses are always outstanding at any one time. All
16licenses issued under this Section shall be valid for a period
17of 3 years. The catch limits established by the Department for
18the taking of yellow perch, and bloater chub, and other
19designated commercial fish species shall be the same for all
20active licensees.
21    (b) At times determined by the Director, the Department
22shall advertise a public drawing to accept new qualified
23commercial fishing candidates and establish a ranking order for

1these new candidates to fill open Lake Michigan commercial
2fishing licenses. This ranking order shall continue to be used
3until the list of eligible candidates is exhausted. Each
4commercial license for the 1992 fishing year and thereafter
5shall be issued as follows:
6        (1) As to all individuals or corporations who held
7    valid licenses as of April 1, 1992, the licenses shall
8    remain in force and effect.
9        (2) Thereafter, licenses shall be issued as necessary
10    to reach and maintain a total of 5 outstanding licenses as
11    follows:
12            (A) First, to any individual or corporation as
13        described in Section 15-5 who was licensed through a
14        harvest contract pursuant to the public lottery
15        drawing conducted by the Director on June 27, 1975, but
16        such individual or corporation did not hold a valid
17        commercial license, for whatever reason, on April 1,
18        1992; provided, that the contractor shall have served
19        any stated period of any license suspension or
20        revocation established by an order of the Director.
21        Among those individuals or corporations that meet the
22        criteria under this item (A), priority shall be given
23        to the individual or corporation that has been without
24        a valid commercial license for the longest period of
25        time.
26            (B) Second, to any other individual or corporate

1        entrant who had his specific name drawn in the public
2        lottery drawing conducted by the Director on June 27,
3        1975, but was not licensed as a harvest contractor at
4        that time or thereafter.
5            (C) Third, if there are insufficient license
6        applicants available at the beginning of any fishing
7        year who meet the requirements for licensure under this
8        Section for the Director to issue 5 licenses, the
9        Director shall order and conduct a new public lottery
10        drawing before the commencement of the fishing year and
11        shall draw the applicant list from a roster of
12        qualified operators.
