HOUSE RESOLUTION

 
2    WHEREAS, The members of the Illinois House of
3Representatives are saddened to learn of the death of former
4Appellate Justice and State Representative Tobias G. "Toby"
5Barry, who passed away on April 4, 2017; and
 
6    WHEREAS, Justice Barry was born in Chicago to Tobias and
7Mary Barry on April 12, 1924; and
 
8    WHEREAS, Justice Barry served from 1943 to 1946 in the
9United States Navy as a combat medic in the Pacific Theater
10during World War II, where he took part in the invasions of Iwo
11Jima and Okinawa before returning to Marquette University to
12complete his undergraduate degree; and
 
13    WHEREAS, Justice Barry earned his Juris Doctorate from the
14University of Notre Dame in 1952 and started his life-long
15legal career; and
 
16    WHEREAS, After the unfortunate and untimely death of his
17father, State Representative Tobias Barry Sr., in 1958, Justice
18Barry ran as an independent for his father's seat when
19Democrats did not select him to fill the seat; and
 
20    WHEREAS, While Justice Barry was not elected in 1958, he

1ran for the seat two years later and was elected as a Democrat;
2and
 
3    WHEREAS, Justice Barry continued to serve as a State
4Representative for 14 years, where he worked tirelessly through
5several administrations with Representative E.J. "Zeke" Giorgi
6for the creation of Interstate 39 as an alternative to U.S.
7Route 51; and
 
8    WHEREAS, Justice Barry finally resigned his seat in the
9legislature in December of 1974 to assume the position of an
10Appellate Judge in the Third Judicial District to which he had
11been elected; and
 
12    WHEREAS, Justice Barry won retention to the bench in 1984,
13and then in 1990, he narrowly lost by less than 3,000 votes for
14a seat on the Supreme Court; and
 
15    WHEREAS, Justice Barry decided to retire from the bench in
161994 to resume private practice with the law firm of Aplington,
17Kaufman, McClintock, Steele, and Barry, Ltd., in LaSalle; and
 
18    WHEREAS, Governor George Ryan named Justice Barry to serve
19on the Illinois Gaming Board in November of 2001; and
 
20    WHEREAS, The Supreme Court asked Justice Barry to return to

1the Third District Appellate Court to fill a vacancy on the
2bench in November of 2002 for two years; and
 
3    WHEREAS, In appreciation for his many contributions to the
4State of Illinois, the 94th General Assembly designated the
5portion of Interstate 39 from LaSalle-Peru to the Zeke Giorgi
6Highway as the Tobias "Toby" Barry Highway; and
 
7    WHEREAS, Justice Barry is survived by his loving wife, Jan;
8his daughter, Michele; his sons, Mark, Patrick, and Daniel;
9seven grandchildren; and innumerable friends; therefore, be it
 
10    RESOLVED, BY THE HOUSE OF REPRESENTATIVES OF THE ONE
11HUNDREDTH GENERAL ASSEMBLY OF THE STATE OF ILLINOIS, that we,
12along with his family and friends, mourn the passing of former
13Appellate Justice and State Representative Tobias "Toby" G.
14Barry; and be it further
 
15    RESOLVED, That a suitable copy of this resolution be
16presented to the family of Justice Barry as an expression of
17our respect and deepest sympathy.
