SYNOPSIS AS INTRODUCED:
 
ILCON Art. IV, Sec. 6

    Proposes to amend The Legislature Article of the Illinois Constitution. Provides that each house shall have a Committee on Assignments composed of 6 members, with 3 members appointed by the presiding officer of that house and 3 members appointed by the minority leader of that house. Provides that no legislation shall be assigned to a committee except by an affirmative vote of at least 4 members of a Committee on Assignments. Provides specific notice and posting requirements for subject matters and legislative measures. Effective upon being declared adopted.

CONSTITUTIONAL AMENDMENT

 
3    RESOLVED, BY THE HOUSE OF REPRESENTATIVES OF THE ONE
4HUNDREDTH GENERAL ASSEMBLY OF THE STATE OF ILLINOIS, THE SENATE
5CONCURRING HEREIN, that there shall be submitted to the
6electors of the State for adoption or rejection at the general
7election next occurring at least 6 months after the adoption of
8this resolution a proposition to amend Section 6 of The
9Legislature Article of the Illinois Constitution as follows:

13SECTION 6. ORGANIZATION
14    (a) A majority of the members elected to each house
15constitutes a quorum.
16    (b) On the first day of the January session of the General
17Assembly in odd-numbered years, the Secretary of State shall
18convene the House of Representatives to elect from its
19membership a Speaker of the House of Representatives as
20presiding officer, and the Governor shall convene the Senate to
21elect from its membership a President of the Senate as
22presiding officer.
23    (c) For purposes of powers of appointment conferred by this

1Constitution, the Minority Leader of either house is a member
2of the numerically strongest political party other than the
3party to which the Speaker or the President belongs, as the
4case may be.
5    (d) Except as otherwise provided in subsection (e), each
6Each house shall determine the rules of its proceedings, judge
7the elections, returns and qualifications of its members and
8choose its officers. No member shall be expelled by either
9house, except by a vote of two-thirds of the members elected to
10that house. A member may be expelled only once for the same
11offense. Each house may punish by imprisonment any person, not
12a member, guilty of disrespect to the house by disorderly or
13contemptuous behavior in its presence. Imprisonment shall not
14extend beyond twenty-four hours at one time unless the person
15persists in disorderly or contemptuous behavior.
16    (e) Each house shall have a Committee on Assignments, which
17shall be the sole committee in each house with the power to
18determine the assignment of legislation to a committee. Each
19Committee on Assignments shall be composed of six members, with
20three members appointed by the presiding officer of that house
21and three members appointed by the Minority Leader of that
22house. No legislation shall be assigned to a committee except
23by the affirmative vote of at least four members of a Committee
24on Assignments.
25    (f) A Committee on Assignments shall not consider or
26conduct a hearing with respect to a subject matter or a

1legislative measure absent notice first being given as follows:
2        (1) One hour advance notice for the consideration of
3    any floor amendment, joint action motion for final action,
4    conference committee report, or motion to table a committee
5    amendment.
6        (2) Seventy-two hours advance notice to consider the
7    referral of bills to committees of the House or joint
8    committees of the House and Senate.
9        (3) Twenty-four hours advance notice for hearings held
10    for purposes not specified in items (1) and (2) of this
11    subsection (f).
12    The Chairperson of the Committee on Assignments shall post
13the notice required under this subsection (f) on the House
14bulletin board identifying each subject matter and each
15legislative measure that may be considered during the hearing.
16The notice shall contain the day, hour, and place of the
17hearing.
18    The posting requirements of items (2) and (3) of this
19subsection (f) may be reduced to a one-hour advance notice upon
20the adoption of a motion by three-fifths of the members
21elected; however, the posting requirement of item (1) of this
22subsection (f) may not be suspended. Notice requirements for
23hearings may be suspended only as authorized by this subsection
24(f), and no hearing shall be conducted with less than a
25one-hour advance notice.

SCHEDULE
2    This Constitutional Amendment takes effect upon being
3declared adopted in accordance with Section 7 of the Illinois
4Constitutional Amendment Act.
