SYNOPSIS AS INTRODUCED:
 
220 ILCS 5/5-118 new

    Amends the Public Utilities Act. Provides that, on April 1 of each year beginning the year after the effective date of the amendatory Act, privately held public water utilities shall provide annual reports to the Illinois Commerce Commission with specified information for each district served by the utility. Provides that privately held public water utilities shall provide to the local emergency services disaster agency any reports discussing the condition of the system in each district for the previous calendar year with information relevant to public safety. Provides that the utilities shall certify the accuracy of the information provided in the reports. Effective immediately.

1    AN ACT concerning regulation.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Public Utilities Act is amended by adding
5Section 5-118 as follows:
 
6    (220 ILCS 5/5-118 new)
7    Sec. 5-118. Water utility pricing reports by district.
8    (a) Privately held public water utilities shall provide to
9the Commission annual reports on April 1 of each year beginning
10the year after the effective date of this amendatory Act of the
11100th General Assembly containing the following information
12for the previous calendar year:
13        (1) the information included in Standard Appendix A in
14    the Statement of Operating Income with Adjustments,
15    including total operating revenue, total operating
16    expenses, net operating income, as well as expenses related
17    to labor, fuel and power, chemicals, waste disposal,
18    management fees, group insurance, pensions, customer
19    accounting, maintenance, depreciation and amortization,
20    state income tax, and federal income tax;
21        (2) the actual cost of capital improvement projects
22    completed during the reporting year;
23        (3) planned capital improvements for each of the coming

1    5 reporting years;
2        (4) usage and revenue data by customer class within the
3    district;
4        (5) any available and applicable water quality
5    reports;
6        (6) reports of any major water leaks;
7        (7) a summary of water loss in the water distribution
8    system for the reporting year;
9        (8) a list of boil orders;
10        (9) a report on water sources divided by surface water
11    and ground water;
12        (10) a summary of revenue and cost information that
13    indicates how common costs to the privately held public
14    water utility are allocated across communities; and
15        (11) techniques and practices for allocated costs.
16    (b) Privately held public water utilities shall provide to
17the local emergency services disaster agency any reports
18discussing the condition of the system in each district with
19information relevant to public safety for the previous calendar
20year.
21    (c) The privately held water utilities shall provide a
22report or reports containing the information specified in
23subsection (a) of this Section for each district served by the
24utilities. The privately held public water utilities shall
25certify the accuracy of the information provided under this
26Section.

2becoming law.
