SYNOPSIS AS INTRODUCED:

65 ILCS 5/8-3-20 new

Amends the Illinois Municipal Code. Provides that, on and after the effective date of this amendatory Act, home rule municipalities and non-home rule municipalities may not impose any tax increase or levy any new or additional tax without prior referendum approval. Limits home rule powers. Effective immediately.

AN ACT concerning local government.

Be it enacted by the People of the State of Illinois, represented in the General Assembly:

Section 5. The Illinois Municipal Code is amended by adding Section 8-3-20 as follows:

(65 ILCS 5/8-3-20 new)

Sec. 8-3-20. Taxing authority; referendum. Notwithstanding any provision of law to the contrary, on and after the effective date of this amendatory Act of the 100th General Assembly, home rule municipalities and non-home rule municipalities may not impose any tax increase or levy any new or additional tax without prior referendum approval. This Section is a denial and limitation of home rule powers and functions under subsection (g) of Section 6 of Article VII of the Illinois Constitution.

Section 99. Effective date. This Act takes effect upon becoming law.
