    Amends the Illinois Promotion Act. Provides that private convention centers are also eligible to receive grants from the Tourism Promotion Fund (currently, units of local government, municipal convention centers, and convention center authorities only). Effective immediately.

1    AN ACT concerning State government.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Illinois Promotion Act is amended by
5changing Sections 3 and 8b as follows:
 
6    (20 ILCS 665/3)  (from Ch. 127, par. 200-23)
7    Sec. 3. Definitions. The following words and terms,
8whenever used or referred to in this Act, shall have the
9following meanings, except where the context may otherwise
10require:
11    (a) "Department" means the Department of Commerce and
12Economic Opportunity of the State of Illinois.
13    (b) "Local promotion group" means any non-profit
14corporation, organization, association, agency or committee
15thereof formed for the primary purpose of publicizing,
16promoting, advertising or otherwise encouraging the
17development of tourism in any municipality, county, or region
18of Illinois.
19    (c) "Promotional activities" means preparing, planning and
20conducting campaigns of information, advertising and publicity
21through such media as newspapers, radio, television,
22magazines, trade journals, moving and still photography,
23posters, outdoor signboards and personal contact within and

1without the State of Illinois; dissemination of information,
2advertising, publicity, photographs and other literature and
3material designed to carry out the purpose of this Act; and
4participation in and attendance at meetings and conventions
5concerned primarily with tourism, including travel to and from
6such meetings.
7    (d) "Municipality" means "municipality" as defined in
8Section 1-1-2 of the Illinois Municipal Code, as heretofore and
9hereafter amended.
10    (e) "Tourism" means travel 50 miles or more one-way or an
11overnight trip outside of a person's normal routine.
12    (f) "Municipal amateur sports facility" means a sports
13facility that: (1) is owned by a unit of local government; (2)
14has contiguous indoor sports competition space; (3) is designed
15to principally accommodate and host amateur competitions for
16youths, adults, or both; and (4) is not used for professional
17sporting events where participants are compensated for their
18participation.
19    (g) "Municipal convention center" means a convention
20center or civic center owned by a unit of local government or
21operated by a convention center authority, or a municipal
22convention hall as defined in paragraph (1) of Section 11-65-1
23of the Illinois Municipal Code, with contiguous exhibition
24space ranging between 30,000 and 125,000 square feet.
25    (h) "Convention center authority" means an Authority, as
26defined by the Civic Center Code, that operates a municipal

1convention center with contiguous exhibition space ranging
2between 30,000 and 125,000 square feet.
3    (i) "Incentive" means: (1) an incentive provided by a
4municipal convention center or convention center authority for
5a convention, meeting, or trade show held at a municipal
6convention center that, but for the incentive, would not have
7occurred in the State or been retained in the State; or (2) an
8incentive provided by a unit of local government for a sporting
9event held at a municipal amateur sports facility that, but for
10the incentive, would not have occurred in the State or been
11retained in the State.
12    (j) "Private convention center" means a convention center
13that is owned and operated by a private entity and has
14contiguous exhibition space ranging between 30,000 and 125,000
15square feet.

18    Sec. 8b. Municipal convention center and sports facility
19attraction grants.
20    (a) Until July 1, 2020, the Department is authorized to
21make grants, subject to appropriation by the General Assembly,
22from the Tourism Promotion Fund to a unit of local government,
23municipal convention center, private convention center, or
24convention center authority that provides incentives, as
25defined in subsection (i) of Section 3 of this Act, for the

1purpose of attracting conventions, meetings, and trade shows to
2those municipal convention centers and attracting sporting
3events to municipal amateur sports facilities. Grants awarded
4under this Section shall be based on the net proceeds received
5under the Hotel Operators' Occupation Tax Act for the renting,
6leasing, or letting of hotel rooms in the municipality for the
7month in which the convention, meeting, trade show, or sporting
8event occurs. Grants shall not exceed 80% of the incentive
9amount provided by the unit of local government, municipal
10convention center, private convention center, or convention
11center authority. Further, in no event may the aggregate amount
12of grants awarded to a single municipal convention center,
13convention center authority, private convention center, or
14municipal amateur sports facility exceed $200,000 in any
15calendar year. The Department may, by rule, require any other
16provisions it deems necessary in order to protect the State's
17interest in administering this program.
18    (b) No later than May 15 of each year, through May 15,
192020, the unit of local government, municipal convention
20center, private convention center, or convention center
21authority shall certify to the Department the amounts of funds
22expended in the previous fiscal year to provide qualified
23incentives; however, in no event may the certified amount
24pursuant to this paragraph exceed $200,000 for any municipal
25convention center, convention center authority, private
26convention center, or municipal amateur sports facility in any

1calendar year. The unit of local government, convention center,
2private convention center, or convention center authority
3shall certify (A) the net proceeds received under the Hotel
4Operators' Occupation Tax Act for the renting, leasing, or
5letting of hotel rooms in the municipality for the month in
6which the convention, meeting, or trade show occurs and (B) the
7average of the net proceeds received under the Hotel Operators'
8Occupation Tax Act for the renting, leasing, or letting of
9hotel rooms in the municipality for the same month in the 3
10immediately preceding years. The unit of local government,
11municipal convention center, private convention center, or
12convention center authority shall include the incentive
13amounts as part of its regular audit.
14    (c) The Department shall submit a report on the
15effectiveness of the program established under this Section to
16the General Assembly no later than January 1, 2020.

18    Section 99. Effective date. This Act takes effect upon
19becoming law.
