SYNOPSIS AS INTRODUCED:

    Amends the Township Code. Provides that if the township board determines that the township clerk has not fulfilled the duties of the office of the township clerk, the township board may, by resolution, provide that the office of the township clerk shall no longer be an elected position, but shall be appointed by the township board. After adoption of a resolution to appoint the township clerk, the elected township clerk's term ends on the appointment of a new township clerk or at the end of the elected township clerk's term, whichever is earlier. Provides for petition and referendum requirements to reinstate an elected township treasurer position.

1    AN ACT concerning local government.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Township Code is amended by changing
5Sections 50-5 and 50-10 and by adding Section 75-50 as follows:
 
6    (60 ILCS 1/50-5)
7    Sec. 50-5. Time of election and terms outside Cook County.
8    (a) Except as provided for Cook County in Sections Section
950-10 and 75-50, and subject to the requirements of the general
10election law and the referendum provisions in Sections 50-25
11and 50-30, at the time of the regular township election
12provided in the general election law, there shall be elected
13one township collector. The collector shall hold his office for
14a term of 4 years and until a successor is elected and
15qualified.
16    (b) At the time of the regular township election provided
17in the general election law, there shall be elected a township
18supervisor. The supervisor shall be ex-officio supervisor of
19general assistance. The supervisor shall hold office for a term
20of 4 years and until a successor is elected and qualified.
21    (c) At the time of the regular township election provided
22in the general election law, there shall be elected one
23township clerk. The clerk shall hold office for a term of 4

1years and until a successor is elected and qualified.
2    (d) At the time of the regular township election provided
3in the general election law, there shall be elected by ballot
4one township or multi-township assessor, as the case may be, in
5the manner provided in the general election law. The assessor
6shall hold office for a term of 4 years and until a successor
7is elected and qualified.

10    Sec. 50-10. Time of election and terms in Cook County.
11    (a) Except as provided for in Section 75-50, township
12Township supervisors, township clerks, and township collectors
13shall be elected in their respective townships in Cook County
14at the time of the regular township election provided in the
15general election law. They shall hold their offices for 4 years
16and until their successors are elected and qualified.
17    (b) Those townships in Cook County lying outside the
18corporate limits of the City of Chicago, the boundaries of
19which are co-extensive with the corporate limits of a city,
20village, or incorporated town, shall elect a township assessor
21at the time of the regular township election provided in the
22general election law. Those township assessors shall hold their
23offices for 4 years and until their successors are elected and
24qualified.

2    Sec. 75-50. Appointment of township clerk.
3    (a) If the township board determines that the township
4clerk has not fulfilled the duties of the office of the
5township clerk, the township board may, by resolution, provide
6that the office of the township clerk shall no longer be an
7elected position, but shall be appointed by the township board.
8After adoption of a resolution to appoint the township clerk,
9the elected township clerk's term ends on the appointment of a
10new township clerk or at the end of the elected township
11clerk's term, whichever is earlier.
12    (b) After a resolution has been adopted under subsection
13(a), voters may initiate a petition for referendum, signed by
14at least 10% of the total number of voters voting at the last
15general election at which the last township clerk was elected,
16to elect the township clerk and file the petition with the
17county clerk not less than 78 days before a regular election.
18The county clerk shall certify for submission the proposition
19of electing the township clerk in accordance with the general
20election law. The proposition shall be in substantially the
21following form:
22        Shall the township clerk be elected for the (name of
23    township)?
24    The votes shall be recorded as "Yes" or "No". If a majority
25of the voters voting on the proposition in the township vote in

1favor of it, then the township clerk shall be elected in the
2township at the next regular election for township offices. The
3appointed township clerk's term shall end when a successor is
4elected and qualified.
