SYNOPSIS AS INTRODUCED:
 
605 ILCS 5/6-133

    Amends the Illinois Highway Code. Allows all boards of trustees of a township (currently, only townships in Cook County) to submit a proposition to abolish a road district of a township to the electors of the township.

1    AN ACT concerning transportation.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Illinois Highway Code is amended by changing
5Section 6-133 as follows:
 
6    (605 ILCS 5/6-133)
7    Sec. 6-133. Abolishing a road district in Cook County. By
8resolution, the board of trustees of any township located in
9Cook County, Illinois, may submit a proposition to abolish the
10road district of that township to the electors of that township
11at a general election or consolidated election in accordance
12with the general election law. The ballot shall be in
13substantially the following form:

15    Shall the Road District of the Township of
16........... be abolished with all the rights,YES
17powers, duties, assets, property, liabilities,
18obligations, and responsibilities being assumed ---------
19by the Township of ........... ? NO

21    In the event that a majority of the electors voting on such

1proposition are in favor thereof, then the road district shall
2be abolished by operation of law effective on January 1 of the
3calendar year immediately following the calendar year in which
4the proposition was approved by the electors.
5    On that date, all the rights, powers, duties, assets,
6property, liabilities, obligations, and responsibilities of
7the road district shall by operation of law vest in and be
8assumed by the township. On that date, the township board of
9trustees shall assume all taxing authority of a road district
10abolished under this Section. On that date, any highway
11commissioner of the abolished road district shall cease to hold
12office, such term having been terminated. Thereafter, the
13township shall exercise all duties and responsibilities of the
14highway commissioner as provided in the Illinois Highway Code.
15The township board of trustees may enter into a contract with
16the county, a municipality, or a private contractor to
17administer the roads under its jurisdiction. The township board
18of trustees shall assume all taxing authority of a township
19road district abolished under this subsection. For purposes of
20distribution of revenue, the township shall assume the powers,
21duties, and obligations of the road district.
