SYNOPSIS AS INTRODUCED:
 
35 ILCS 200/15-190 new
70 ILCS 605/1-8 new

    Amends the Property Tax Code. Provides that all property used exclusively for public or conservation purposes belonging to a forest preserve district or a conservation district is exempt from taxation. Amends the Illinois Drainage Code. Provides that before any action may be taken by a drainage district regarding property owned or operated by a forest preserve district organized pursuant to the Downstate Forest Preserve District Act or a conservation district organized pursuant to the Conservation District Act, the drainage district shall first receive approval for the action from the board of commissioners of the forest preserve district or the board of trustees of the conservation district. Effective immediately.

1    AN ACT concerning local government.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Property Tax Code is amended by adding
5Section 15-190 as follows:
 
6    (35 ILCS 200/15-190 new)
7    Sec. 15-190. Forest preserve districts; conservation
8districts. All property used exclusively for public or
9conservation purposes belonging to a forest preserve district
10organized under the Downstate Forest Preserve District Act or a
11conservation district organized under the Conservation
12District Act is exempt.
 
13    Section 10. The Illinois Drainage Code is amended by adding
14Section 1-8 as follows:
 
15    (70 ILCS 605/1-8 new)
16    Sec. 1-8. Forest preserve districts and conservation
17districts.
18    (a) Notwithstanding any other provision of law to the
19contrary, before any action may be taken by a drainage district
20regarding property owned or operated by a forest preserve
21district organized pursuant to the Downstate Forest Preserve

1District Act or a conservation district organized pursuant to
2the Conservation District Act, the drainage district shall
3first receive approval for the action from the board of
4commissioners of the forest preserve district or the board of
5trustees of the conservation district.
6    (b) As used in this Section:
7    "Action" means any action by a drainage district under
8Section 3-29, 4-14, 4-16, 4-27, 4-30, or under the drainage
9district's eminent domain powers, including, but not limited
10to, Section 4-17.
11    "Approval" means approval by a majority vote of the board
12of commissioners of a forest preserve district or the board of
13trustees of a conservation district or by agreement under the
14Intergovernmental Cooperation Act between the drainage
15district and the forest preserve district or conservation
16district.
 
17    Section 99. Effective date. This Act takes effect upon
18becoming law.
