SYNOPSIS AS INTRODUCED:
 
50 ILCS 205/21 new
30 ILCS 805/8.41 new

    Amends the Local Records Act. Provides that a unit of local government or school district that serves a population of less than 1,000,000 that maintains an Internet website other than a social media or social networking website shall post to its website for the current calendar year a mechanism, such as a uniform, single email address, for members of the public to electronically communicate with elected officials of that unit of local government or school district. Requires the information to be easily accessible from the unit of local government's or school district's home page through a hyperlink. Limits home rule powers. Amends the State Mandates Act to require implementation without reimbursement.

1    AN ACT concerning local government.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Local Records Act is amended by adding
5Section 21 as follows:
 
6    (50 ILCS 205/21 new)
7    Sec. 21. Internet posting requirements.
8    (a) A unit of local government or school district that
9serves a population of less than 1,000,000 that maintains an
10Internet website other than a social media website or social
11networking website shall, within 90 days of the effective date
12of this amendatory Act of the 100th General Assembly, post to
13its website for the current calendar year a mechanism, such as
14a uniform single email address, for members of the public to
15electronically communicate with elected officials of that unit
16of local government or school district, unless such officials
17have an individual email address for that purpose.
18    (b) For the purposes of this Section "Internet website"
19shall not include any social media website, social networking
20website, or any other social media presence that a unit of
21local government or school district maintains.
22    (c) A hyperlink to the information required to be posted
23under this Section must be easily accessible from the unit of

1local government's or school district's home page.
2    (d) The postings required by this Section are in addition
3to any other posting requirements required by law or ordinance.
4    (e) No home rule unit may adopt posting requirements that
5are less restrictive than this Section. This Section is a
6limitation under subsection (i) of Section 6 of Article VII of
7the Illinois Constitution on the concurrent exercise by home
8rule units of powers and functions exercised by the State.
 
9    Section 90. The State Mandates Act is amended by adding
10Section 8.41 as follows:
 
11    (30 ILCS 805/8.41 new)
12    Sec. 8.41. Exempt mandate. Notwithstanding Sections 6 and 8
13of this Act, no reimbursement by the State is required for the
14implementation of any mandate created by this amendatory Act of
15the 100th General Assembly.
