SYNOPSIS AS INTRODUCED:

    Amends the Election Code. Provides that each election authority operating in a county organized by township shall operate one grace period voter registration site within each township under the jurisdiction of the election authority. Provides that each election authority operating in a county organized by precinct shall operate one grace period voter registration site within each precinct under the jurisdiction of the election authority. Provides that the Board of Election Commissioners for the City of Chicago shall operate one grace period voter registration site within each former township located within the City of Chicago, as those townships existed immediately prior to the date those townships were eliminated within the City of Chicago.

1    AN ACT concerning elections.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Election Code is amended by changing
5Sections 4-50, 5-50, and 6-100 and by adding Section 1-12.5 as
6follows:
 
7    (10 ILCS 5/1-12.5 new)
8    Sec. 1-12.5. Grace period registration.
9    (a) Notwithstanding any other provision of law to the
10contrary, the number of grace period voter registration sites
11that each election authority shall establish is governed only
12by this Section. For the purpose of establishing grace period
13voter registration sites, election authorities shall be
14classified as follows:
15        (1) election authorities operating in counties
16    organized by township, including, but not limited to,
17    election authorities operating in Cook County, but
18    excluding the Board of Election Commissioners for the City
19    of Chicago;
20        (2) election authorities operating in counties
21    organized by precinct; and
22        (3) the Board of Election Commissioners for the City of
23    Chicago.

1    (b) Each election authority classified under paragraph (1)
2of subsection (a) of this Section shall operate one grace
3period voter registration site within each township under the
4jurisdiction of the election authority. Each election
5authority classified under paragraph (2) of subsection (a) of
6this Section shall operate one grace period voter registration
7site within each precinct under the jurisdiction of the
8election authority. The Board of Election Commissioners for the
9City of Chicago shall operate one grace period voter
10registration site within each former township located within
11the City of Chicago, as those townships existed immediately
12prior to the date those townships were eliminated within the
13City of Chicago. In the case of a township, precinct, or former
14township that contains the office of the election authority,
15the office of the election authority shall serve as the grace
16period voter registration site for that township, precinct, or
17former township.

19    Sec. 4-50. Grace period. Notwithstanding any other
20provision of this Code to the contrary, each election authority
21shall establish procedures for the registration of voters and
22for change of address during the period from the close of
23registration for an election until and including the day of the
24election. During this grace period, an unregistered qualified
25elector may register to vote, and a registered voter may submit

1a change of address form, in person in the office of the
2election authority, at a permanent polling place established
3under Section 19A-10, at any other early voting site beginning
415 days prior to the election, at a polling place on election
5day, or at a voter registration location specifically
6designated for this purpose by the election authority as
7provided in Section 1-12.5. The election authority shall
8register that individual, or change a registered voter's
9address, in the same manner as otherwise provided by this
10Article for registration and change of address.
11    If a voter who registers or changes address during this
12grace period wishes to vote at the election or primary
13occurring during the grace period, he or she must do so by
14grace period voting. The election authority shall offer
15in-person grace period voting at the authority's office, any
16permanent polling place established under Section 19A-10, and
17at any other early voting site beginning 15 days prior to the
18election, at a polling place on election day, where grace
19period registration is required by this Section; and may offer
20in-person grace period voting at additional hours and locations
21specifically designated for the purpose of grace period voting
22by the election authority. The election authority may allow
23grace period voting by mail only if the election authority has
24no ballots prepared at the authority's office. Grace period
25voting shall be in a manner substantially similar to voting
26under Article 19A.

1    Within one day after a voter casts a grace period ballot,
2or within one day after the ballot is received by the election
3authority if the election authority allows grace period voting
4by mail, the election authority shall transmit by electronic
5means pursuant to a process established by the State Board of
6Elections the voter's name, street address, e-mail address, and
7precinct, ward, township, and district numbers, as the case may
8be, to the State Board of Elections, which shall maintain those
9names and that information in an electronic format on its
10website, arranged by county and accessible to State and local
11political committees. The name of each person issued a grace
12period ballot shall also be placed on the appropriate precinct
13list of persons to whom vote by mail and early ballots have
14been issued, for use as provided in Sections 17-9 and 18-5.
15    A person who casts a grace period ballot shall not be
16permitted to revoke that ballot and vote another ballot with
17respect to that primary or election. Ballots cast by persons
18who register or change address during the grace period at a
19location other than their designated polling place on election
20day must be transmitted to and counted at the election
21authority's central ballot counting location and shall not be
22transmitted to and counted at precinct polling places. The
23grace period ballots determined to be valid shall be added to
24the vote totals for the precincts for which they were cast in
25the order in which the ballots were opened.
26    In counties with a population of less than 100,000 that do

1not have electronic poll books, the election authority may opt
2out of registration in the polling place if the election
3authority establishes grace period registration and voting at
4other sites on election day at the following sites: (i) the
5election authority's main office and (ii) a polling place in
6each municipality where 20% or more of the county's residents
7reside if the election authority's main office is not located
8in that municipality. The election authority may establish
9other grace period registration and voting sites on election
10day provided that the election authority has met the notice
11requirements of Section 19A-25 for permanent and temporary
12early voting sites.
