SYNOPSIS AS INTRODUCED:
 
415 ILCS 5/22.54a

    Amends the Environmental Protection Act. Provides that no owner or operator of a landfill within a 25-mile radius of a facility accepting exclusively general construction or demolition debris for transfer, storage, or treatment shall accept whole or processed asphalt roofing shingles for disposal. Requires the Illinois Environmental Protection Agency to post on its website the name and address of facilities accepting exclusively general construction or demolition debris for transfer, storage, or treatment. Changes the repeal date for a Section concerning the disposal of asphalt roofing shingles from February 1, 2018 to February 1, 2019. Effective immediately.

1    AN ACT concerning safety.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Environmental Protection Act is amended by
5changing Section 22.54a as follows:
 
6    (415 ILCS 5/22.54a)
7    (Section scheduled to be repealed on February 1, 2018)
8    Sec. 22.54a. Disposal of asphalt roofing shingles. No owner
9or operator of a sanitary landfill that is located within a
1025-mile radius of both a facility located and operated pursuant
11to Section 22.38 of this Act and a site where asphalt roofing
12shingles are recycled under a Beneficial Use Determination
13(BUD) issued by the Agency pursuant to Section 22.54 of this
14Act shall accept for disposal loads of whole or processed
15asphalt roofing shingles. Nothing in this Section shall
16prohibit or restrict a sanitary landfill from accepting for
17disposal asphalt roofing shingles that are commingled with
18municipal waste, including, but not limited to, general
19construction or demolition debris.
20    The Agency shall post on its website the name and address
21of each facility located and operated pursuant to Section 22.38
22of this Act and each site at which the recycling of asphalt
23roofing shingles under a BUD is approved.

1    No later than January 31 of each year, each recipient of a
2BUD for asphalt roofing shingles shall submit a report to the
3Agency that contains the following information: (i) the total
4quantity of asphalt roofing shingles received under the BUD
5during the previous calendar year; (ii) the beneficial uses
6during the previous calendar year of shingles received under
7the BUD; (iii) the total quantity of shingles used in each
8beneficial use during the previous calendar year; and (iv) the
9total quantity and disposition of any shingles received but not
10beneficially used under the BUD during the previous calendar
11year. The report must be submitted on a form and in a format
12prescribed by the Agency.
13    This Section is repealed on February 1, 2019 2018.

15    Section 99. Effective date. This Act takes effect upon
16becoming law.
