SYNOPSIS AS INTRODUCED:
 
520 ILCS 5/2.38  from Ch. 61, par. 2.38
520 ILCS 5/3.1-9

    Amends the Wildlife Code. Provides that anyone filling a deer tag who has a Youth Hunting License may transfer the tag to the accompanying adult hunter if the youth is present at the time the tag is filled by the adult. Removes the prohibition on transferring deer tags in compliance with the youth hunting provision.

1    AN ACT concerning wildlife.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Wildlife Code is amended by changing
5Sections 2.38 and 3.1-9 as follows:
 
6    (520 ILCS 5/2.38)  (from Ch. 61, par. 2.38)
7    Sec. 2.38. No person shall at any time:
8        (1) falsify, alter or change in any manner, or provide
9    deceptive or false information required for, any license,
10    permit or tag issued under the provisions hereof;
11        (2) falsify any record required by this Act;
12        (3) counterfeit any form of license, permit or tag
13    provided for by this Act;
14        (4) loan or transfer to another person any license,
15    permit, or tag issued under this Act except as provided
16    under Section 3.1-9; or
17        (5) use in the field any license, permit, or tag issued
18    to another person.
19    It is unlawful to possess any license, permit or tag issued
20under the provisions of this Act which was fraudulently
21obtained, or which the possessor knew, or should have known,
22was falsified, altered, changed in any manner or fraudulently
23obtained.

1    The Department shall suspend the privileges, under this
2Act, of any person found guilty of violating this Section for a
3period of not less than one year.

6    Sec. 3.1-9. Youth Hunting License. Any resident youth age
718 and under may apply to the Department for a Youth Hunting
8License, which extends limited hunting privileges. The Youth
9Hunting License shall be a renewable license that shall expire
10on the March 31 following the date of issuance.
11    For youth age 18 and under, the Youth Hunting License shall
12entitle the licensee to hunt while supervised by a parent,
13grandparent, or guardian who is 21 years of age or older and
14has a valid Illinois hunting license. Possession of a Youth
15Hunting License shall serve in lieu of a valid hunting license,
16but does not exempt the licensee from compliance with the
17requirements of this Code and any rules adopted under this
18Code.
19    A youth licensed under this Section shall not hunt or carry
20a hunting device, including, but not limited to, a firearm, bow
21and arrow, or crossbow unless the youth is accompanied by and
22under the close personal supervision of a parent, grandparent,
23or guardian who is 21 years of age or older and has a valid
24Illinois hunting license.
25    At age 19 years or when the youth chooses to hunt by

1himself or herself, he or she is required to successfully
2complete a hunter safety course approved by the Department
3prior to being able to obtain a full hunting license and
4subsequently hunt by himself or herself.
5    In order to be approved for the Youth Hunting License, the
6applicant must request a Youth Hunting License from the
7Department and submit a $7 fee, which shall be separate from
8and additional to any other stamp, permit, tag, or license fee
9that may be required for hunting under this Code. The
10Department shall adopt rules for the administration of the
11program, but shall not require any certificate of competency or
12other hunting education as a condition of the Youth Hunting
13License.
14    Anyone filling a deer tag who has a Youth Hunting License
15may transfer the tag to the accompanying adult hunter if the
16youth is present at the time the tag is filled by the adult.
