SYNOPSIS AS INTRODUCED:
 
20 ILCS 3005/5.2 new

    Amends the Governor's Office of Management and Budget Act. Provides that requests for federal funding by State agencies shall be filed with the Governor's Office of Management and Budget, and posted on the Office's website for public comment, at least 30 days prior to making the request for funding to the federal government. Provides that requests for federal funding by State agencies exceeding $250,000 in a fiscal year shall be filed with the Joint Committee on Federal Funding Requests. Creates the Joint Committee on Federal Funding Requests. Provides that requests for federal funding that have not been filed with the Governor's Office of Management and Budget, or approved by a majority vote of the Joint Committee on Federal Funding Requests, as applicable, shall be void and any funds received shall be returned to the federal government. Effective July 1, 2015.

1    AN ACT concerning State government.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Governor's Office of Management and Budget
5Act is amended by adding Section 5.2 as follows:
 
6    (20 ILCS 3005/5.2 new)
7    Sec. 5.2. Federal funding requests.
8    (a) In addition to the requirements of Section 5.1, and
9under such regulations as the Governor may prescribe, every
10State agency, other than State colleges and universities,
11agencies of legislative and judicial branches of State
12government, and elected State executive officers not including
13the Governor, shall file with the Governor's Office of
14Management and Budget all requests for federal funding by that
15agency for new or continued projects or maintenance of federal
16projects. Requests shall be filed and posted on the website of
17the Governor's Office of Management and Budget not less than 30
18days prior to the official request for funds to the federal
19government to allow for public comment.
20    Each request for federal funding received by the Governor's
21Office of Management and Budget shall be assigned a unique
22identification number by the Office, to allow for tracking of
23the request together with any related projects and funding.

1    Any request for federal funding subject to the requirements
2of this subsection which has not been filed with the Governor's
3Office of Management and Budget shall be void, and any funds
4received shall be returned to the federal government before
5they are spent.
6    (b) In addition to the requirements of subsection (a), all
7requests that exceed $250,000 within a fiscal year must be
8submitted to the Joint Committee on Federal Funding Requests
9for its approval not less than 30 days prior to the official
10request of funds to the federal government. A report prepared
11by the State agency showing liability to the State, if any,
12created by the funding request must be submitted to the Joint
13Committee together with the funding request.
14    Any request for federal funding subject to the requirements
15of this subsection (b) which has not been approved by the Joint
16Committee on Federal Funding Requests shall be void, and any
17funds received shall be returned to the federal government
18before they are spent.
19    (c) There is created the Joint Committee on Federal Funding
20Requests, comprised of 12 members of the General Assembly
21appointed as follows: 3 by the Speaker of the House of
22Representatives, one of whom shall serve as co-chair; 3 by the
23Minority Leader of the House of Representatives; 3 by the
24President of the Senate, one of whom shall serve as co-chair;
25and 3 by the Minority Leader of the Senate. The Joint Committee
26shall by majority vote approve or deny each request for federal

1funding submitted to it. If no vote is taken upon a request for
2federal funding within 90 calendar days from its receipt by the
3Joint Committee, that request shall be considered to have been
4approved by the Joint Committee.
 
5    Section 99. Effective date. This Act takes effect July 1,
62015.
