SYNOPSIS AS INTRODUCED:
 
70 ILCS 920/5.3b new

    Amends the Tuberculosis Sanitarium District Act. Provides that a tuberculosis sanitarium district entirely within a county with a population of less than 500,000 may dissolve by resolution of the county board. Further provides that in order to dissolve the district, there must be a county health department servicing the entire county which will assume responsibility for tuberculosis care; the board of directors of the tuberculosis sanitarium district must agree by resolution to be dissolved; and that the resolution of the county board must (1) allow an additional tax not to exceed 0.05% of the value as equalized or assessed by the Department of Revenue for the benefit of the board of health, (2) provide for the transfer of assets and liabilities of the district, (3) provide for the assumption of responsibility for patient care, and (4) provide for an increase in the members on the county board of health.

1    AN ACT concerning local government.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Tuberculosis Sanitarium District Act is
5amended by adding Section 5.3b as follows:
 
6    (70 ILCS 920/5.3b new)
7    Sec. 5.3b. Dissolution of district in a county with a
8population of less than 500,000. In counties with a population
9of less than 500,000 in which a tuberculosis sanitarium
10district exists entirely within the county, a tuberculosis
11sanitarium district may be dissolved by resolution of the
12county board provided that:
13        (a) there exists a county or multiple-county health
14    department serving the entire county and the board of
15    health of that department has affirmed its willingness to
16    assume responsibility for the tuberculosis care and
17    treatment program as indicated by their adoption of a
18    resolution by a majority vote and transmittal of a copy of
19    that resolution to the county board and the tuberculosis
20    district board of directors;
21        (b) the board of directors of the tuberculosis
22    sanitarium district by a majority vote adopt a written
23    resolution recommending to the county board that the

1    district be dissolved; and
2        (c) the resolution of the county board also provides:
3            (1) that an additional tax not to exceed 0.05% of
4        the value as equalized or assessed by the Department of
5        Revenue be made available to the board of health, in
6        addition to that authorized in "An Act in relation to
7        the establishment and maintenance of county and
8        multiple-county public health departments", approved
9        July 9, 1943, which tax shall be collected annually on
10        all taxable property in the county in like manner with
11        the general taxes of the county, and which shall be
12        deposited in the County Health Fund along with other
13        funds available to the board of health;
14            (2) that a portion of the additional tax authorized
15        pursuant to paragraph (1) of this subsection (c), in
16        the amount determined to be necessary and budgeted by
17        the county board of health for the control of
18        tuberculosis, shall be provided by the county board as
19        a part of the county health department's budget;
20            (3) that all assets and liabilities of the
21        tuberculosis sanitarium district be transferred to the
22        board of health;
23            (4) that the board of health assume responsibility
24        for the outpatient care and treatment of individuals
25        diagnosed as having tuberculosis and for follow-up and
26        prophylactic treatment of persons who have had contact

1        with a diagnosed case of tuberculosis consistent with
2        the rules and regulations of the Illinois Department of
3        Public Health, but not be responsible for inpatient
4        treatment; and
5            (5) that the county board of health be increased
6        from 8 members to 11 members, the additional 3 members
7        to be appointed in the same manner as is provided in
8        Section 13 of "An Act in relation to the establishment
9        and maintenance of county and multiple-county public
10        health departments", approved July 9, 1943. The
11        initial 3 additional members appointed pursuant to
12        this Section shall be chosen from among the members of
13        the tuberculosis sanitarium district board dissolved
14        pursuant to this Section.
