SYNOPSIS AS INTRODUCED:

725 ILCS 5/103-2

from Ch. 38, par. 103-2

Amends the Code of Criminal Procedure of 1963. In provision regarding medical treatment for persons in custody, requires any required medical treatment to be provided without unreasonable delay if the need for the treatment is apparent.

A BILL FOR

AN ACT concerning criminal law.

Be it enacted by the People of the State of Illinois, represented in the General Assembly:

Section 5. The Code of Criminal Procedure of 1963 is amended by changing Section 103-2 as follows:

(725 ILCS 5/103-2) (from Ch. 38, par. 103-2)

Sec. 103-2. Treatment while in custody.

(a) On being taken into custody every person shall have the right to remain silent.

(b) No unlawful means of any kind shall be used to obtain a statement, admission or confession from any person in custody.

(c) Persons in custody shall be treated humanely and provided with proper food, shelter and, if required, medical treatment without unreasonable delay if the need for the treatment is apparent.
