SYNOPSIS AS INTRODUCED:
 
20 ILCS 2610/9  from Ch. 121, par. 307.9

    Amends the State Police Act. Provides that preference for the hiring of an Illinois State Police officer shall be given to the son, daughter, stepson, stepdaughter, grandson, granddaughter, brother, or sister of a law enforcement officer who was killed in the line of duty. Effective immediately.

1    AN ACT concerning State government.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 1. This Act may be referred to as the Illinois
5State Police Line of Duty Preference Act of 2019.
 
6    Section 5. The State Police Act is amended by changing
7Section 9 as follows:

9    Sec. 9. Appointment; qualifications.
10    (a) Except as otherwise provided in this Section, the
11appointment of Department of State Police officers shall be
12made from those applicants who have been certified by the Board
13as being qualified for appointment. All persons so appointed
14shall, at the time of their appointment, be not less than 21
15years of age, or 20 years of age and have successfully
16completed an associate's degree or 60 credit hours at an
17accredited college or university. Any person appointed
18subsequent to successful completion of an associate's degree or
1960 credit hours at an accredited college or university shall
20not have power of arrest, nor shall he or she be permitted to
21carry firearms, until he or she reaches 21 years of age. In
22addition, all persons so certified for appointment shall be of

1sound mind and body, be of good moral character, be citizens of
2the United States, have no criminal records, possess such
3prerequisites of training, education, and experience as the
4Board may from time to time prescribe so long as persons who
5have an associate's degree or 60 credit hours at an accredited
6college or university are not disqualified, and shall be
7required to pass successfully such mental and physical tests
8and examinations as may be prescribed by the Board. All persons
9who meet one of the following requirements are deemed to have
10met the collegiate educational requirements:
11        (i) have been honorably discharged and who have been
12    awarded a Southwest Asia Service Medal, Kosovo Campaign
13    Medal, Korean Defense Service Medal, Afghanistan Campaign
14    Medal, Iraq Campaign Medal, or Global War on Terrorism
15    Expeditionary Medal by the United States Armed Forces;
16        (ii) are active members of the Illinois National Guard
17    or a reserve component of the United States Armed Forces
18    and who have been awarded a Southwest Asia Service Medal,
19    Kosovo Campaign Medal, Korean Defense Service Medal,
20    Afghanistan Campaign Medal, Iraq Campaign Medal, or Global
21    War on Terrorism Expeditionary Medal as a result of
22    honorable service during deployment on active duty;
23        (iii) have been honorably discharged who served in a
24    combat mission by proof of hostile fire pay or imminent
25    danger pay during deployment on active duty; or
26        (iv) have at least 3 years of full active and

1    continuous military duty and received an honorable
2    discharge before hiring.
3    Preference shall be given in such appointments to persons
4who have honorably served in the military or naval services of
5the United States or to the son, daughter, stepson,
6stepdaughter, grandson, granddaughter, brother, or sister of a
7law enforcement officer who was killed in the line of duty as
8defined in Section 2 of the Line of Duty Compensation Act. All
9appointees shall serve a probationary period of 12 months from
10the date of appointment and during that period may be
11discharged at the will of the Director. However, the Director
12may in his or her sole discretion extend the probationary
13period of an officer up to an additional 6 months when to do so
14is deemed in the best interest of the Department. Nothing in
15this subsection (a) limits the Board's ability to prescribe
16education prerequisites or requirements to certify Department
17of State Police officers for promotion as provided in Section
1810 of this Act.
19    (b) Notwithstanding the other provisions of this Act, after
20July 1, 1977 and before July 1, 1980, the Director of State
21Police may appoint and promote not more than 20 persons having
22special qualifications as special agents as he or she deems
23necessary to carry out the Department's objectives. Any such
24appointment or promotion shall be ratified by the Board.
25    (c) During the 90 days following the effective date of this
26amendatory Act of 1995, the Director of State Police may

1appoint up to 25 persons as State Police officers. These
2appointments shall be made in accordance with the requirements
3of this subsection (c) and any additional criteria that may be
4established by the Director, but are not subject to any other
5requirements of this Act. The Director may specify the initial
6rank for each person appointed under this subsection.
7    All appointments under this subsection (c) shall be made
8from personnel certified by the Board. A person certified by
9the Board and appointed by the Director under this subsection
10must have been employed by the Illinois Commerce Commission on
11November 30, 1994 in a job title subject to the Personnel Code
12and in a position for which the person was eligible to earn
13"eligible creditable service" as a "noncovered employee", as
14those terms are defined in Article 14 of the Illinois Pension
15Code.
16    Persons appointed under this subsection (c) shall
17thereafter be subject to the same requirements and procedures
18as other State police officers. A person appointed under this
19subsection must serve a probationary period of 12 months from
20the date of appointment, during which he or she may be
21discharged at the will of the Director.
22    This subsection (c) does not affect or limit the Director's
23authority to appoint other State Police officers under
24subsection (a) of this Section.
