SYNOPSIS AS INTRODUCED:
 
430 ILCS 115/4  from Ch. 67 1/2, par. 504

    Amends the Illinois Modular Dwelling and Mobile Structure Safety Act. Provides that the Act (currently, a provision of the Act) is a limitation on the concurrent exercise by home rule units with a population of less than 1,000,000 (currently, just home rule units) of powers and functions exercised by the State.

1    AN ACT concerning safety.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Illinois Modular Dwelling and Mobile
5Structure Safety Act is amended by changing Section 4 as
6follows:
 
7    (430 ILCS 115/4)  (from Ch. 67 1/2, par. 504)
8    Sec. 4. (a) No person may rent, sell, or offer for sale to
9anyone within this State any modular dwelling or mobile
10structure after the effective date of this amendatory Act of
11the 98th General Assembly, unless it bears a seal issued by the
12Department and a certification by the manufacturer, that the
13mobile structure or modular dwelling complies with the
14applicable safety code.
15    (b) Nothing in this Act prohibits a city, town, village,
16township, or county from adopting construction standards for
17mobile structures or modular dwellings under local ordinances,
18provided such ordinances incorporate the rules adopted under
19this Act and are approved by the Department. This Act Section
20is a limitation under subsection (i) of Section 6 of Article
21VII of the Illinois Constitution on the concurrent exercise by
22home rule units with a population of less than 1,000,000 of
23powers and functions exercised by the State.

1    (c) Any unit of local government is authorized to adopt by
2reference the safety codes as promulgated by the Department.
