SYNOPSIS AS INTRODUCED:
 
New Act

    Creates the Truth in Legislative Taxation Act. Provides that every new Act that creates a new tax or fee or increases an existing tax or fee shall include the words "Tax Increase", "Fee Increase", or "Tax and Fee Increase" in its short title. Requires the sponsor of the new Act to inform the Legislative Reference Bureau that the new Act creates a new tax or fee or increases an existing tax or fee each time a drafting request is made related to that new Act. Requires the sponsor to provide a statement of legislative intent to the Legislative Reference Bureau that describes each new or increased tax or fee in the new Act and that sets forth the reason for each new or increased tax or fee. Directs the Legislative Reference Bureau to: ensure that the short title of the new Act conforms to the naming requirements of this Act; include the statement of legislative intent provided by the sponsor in the Section of the new Act immediately following the short title; and in its synopsis of the bill or amendment, state that the new Act creates a new tax or fee or increases an existing tax or fee. Where the new Act is drafted in the form of bill, directs the Legislative Reference Bureau to affix to the first page of the bill a stamp or words indicating that the new Act is one to which this Act applies. Provides corresponding requirements for amendatory Acts. Effective immediately.

1    AN ACT concerning State government.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 1. Short title. This Act may be cited as the Truth
5in Legislative Taxation Act.
 
6    Section 5. New Acts.
7    (a) Each time a drafting request that (i) creates a new tax
8or fee as part of a new Act or (ii) increases an existing tax or
9fee as part of a new Act is submitted to the Legislative
10Reference Bureau, the sponsor shall inform the Legislative
11Reference Bureau that the request creates a new tax or fee or
12increases an existing tax or fee.
13    (b) The sponsor of a new Act described in subsection (a)
14shall inform the Legislative Reference Bureau that the new Act
15creates a new tax or fee, or increases an existing tax or fee,
16each time a drafting request is made related to that new Act.
17The sponsor shall also provide a statement of legislative
18intent to the Legislative Reference Bureau that describes each
19new or increased tax or fee in the new Act and sets forth the
20reason for each new or increased tax or fee.
21    (c) Based on the information provided under subsection (b),
22the Legislative Reference Bureau shall: (i) ensure that the
23short title of the new Act conforms to the requirements of

1subsection (a); (ii) include the statement of legislative
2intent provided by the sponsor in the Section of the new Act
3immediately following the short title; and (iii) in its
4synopsis of the bill or amendment, state that the new Act

6If the new Act is drafted in the form of bill, the Legislative
7Reference Bureau shall also affix to the first page of the bill
8a stamp or words indicating that the new Act is one to which
9this Act applies.
 
10    Section 10. Amendatory Acts.
11    (a) Each time a drafting request that (i) creates a new tax
12or fee as part of an amendatory Act or (ii) increases an
13existing tax or fee as part of an amendatory Act is submitted
14to the Legislative Reference Bureau, the sponsor shall inform
15the Legislative Reference Bureau that the request creates a new
16tax or fee or increases an existing tax or fee.
17    (b) Based on the information provided under subsection (a),
18the Legislative Reference Bureau shall: (i) include the
19statement of legislative intent provided by the sponsor in the
20first Section of the amendatory Act; and (ii) in its synopsis
21of the bill or amendment, state that the amendatory Act creates
22a new tax or fee or increases an existing tax or fee. If the
23amendatory Act is drafted in the form of bill, the Legislative
24Reference Bureau shall also affix to the first page of the bill
25a stamp or words indicating that the amendatory Act is one to

2    Section 99. Effective date. This Act takes effect upon
3becoming law.
