SENATE RESOLUTION

 
2    WHEREAS, In 2012, the General Assembly passed the Save
3Medicaid Access and Resources Together (SMART) Act (Public Act
497-689), an initiative to save approximately $1.6 billion in
5State Medicaid spending through the enactment of spending
6reductions, utilization controls, and provider rate cuts; and
 
7    WHEREAS, The SMART Act required the Department of
8Healthcare and Family Services to file a report with the
9Auditor General, the Governor, and leaders of the General
10Assembly that listed any necessary amendments to the Illinois
11Title XIX State plan, federal waiver request, or State
12administrative rules necessary to implement the SMART Act; and
 
13    WHEREAS, At a press conference announcing her appointment
14as Director of Healthcare and Family Services, Julie Hamos
15stated that "my approach... will be to bring all of you to the
16table... those of you who are interested in health care will
17have a place at this table. We need to hear the disparate
18voices... and we need to build a strong coalition statewide.";
19and
 
20    WHEREAS, Since that time, Director Hamos has repeatedly
21denied interested parties access to her in order to share their
22concerns and ideas regarding the implementation of the SMART

1Act and its effects on the State's Medicaid program; and
 
2    WHEREAS, The Department of Healthcare and Family Services
3was created to provide necessary services to those who are most
4in need in the State of Illinois; Director Hamos has promised
5the people of Illinois that she would do everything in her
6power to ensure that these people would receive the services
7they deserve; and
 
8    WHEREAS, Director Hamos' consistent lack of openness in
9these proceedings and her unwillingness to take forward steps
10in serving the neediest people of this State represents a grave
11dereliction of her duties; therefore, be it
 
12    RESOLVED, BY THE SENATE OF THE NINETY-EIGHTH GENERAL
13ASSEMBLY OF THE STATE OF ILLINOIS, that we call upon the
14Governor to instruct the Department of Healthcare and Family
15Services to ensure any movement of Medicaid lives to HMOs does
16not result in a reduction of federal revenues garnered through
17the Hospital Assessment program and to ensure that any
18reimbursement system associated with HMOs must not be
19implemented prior to receiving written federal approval; and be
20it further
 
21    RESOLVED, That we call upon the Governor to instruct the
22Department of Healthcare and Family Services to establish a

1medical loss ratio of no less than 88% for all mandatorily
2enrolled MCO programs, consistent with practices established
3under the Integrated Care Pilot Program; and be it further
 
4    RESOLVED, That we call upon the Governor to instruct the
5Department to develop and implement a potentially preventable
6readmissions policy consistent with Section 15-5 of the Public
7Aid Code (305 ILCS 5/15-5); and be it further
 
8    RESOLVED, That we call upon the Governor to instruct the
9Department to move immediately to garner federal approval for
10the Hospital Assessment Program, prescribed in the SMART Act;
11and be it further
 
12    RESOLVED, That we call upon the Governor to include
13reimbursement policies that, in total, provide for a positive
14operating margin for safety-net hospitals, as part of the Rate
15Reform development process; and be it further
 
16    RESOLVED, That we call upon the Governor to immediately pay
17all supplemental hospital payments that have been approved by
18the Joint Committee on Administrative Rules; and be it further
 
19    RESOLVED, That suitable copies of this resolution be
20delivered to the Governor and the Director of Healthcare and
21Family Services.
