SENATE RESOLUTION

 
2    WHEREAS, The Illinois Environmental Protection Agency
3maintains jurisdiction over and has the authority to issue
4Beneficial Use Determinations for asphalt roofing shingles in
5the State of Illinois; and
 
6    WHEREAS, Senate Bill 1925 of this 98th General Assembly
7will require the Illinois Environmental Protection Agency to
8conduct an evaluation of an applicant's prior experience in
9asphalt shingle recycling operations prior to issuing a
10Beneficial Use Determination for asphalt shingles; and
 
11    WHEREAS, In 2011, the Illinois Senate passed HB1326, now
12Public Act 97-0314, which authorized the Illinois Department of
13Transportation ("Department") to use recycled asphalt shingles
14in its hot mix asphalt projects; and
 
15    WHEREAS, The Department has developed an approval process
16for the acceptance of recycled asphalt shingles into hot mix
17asphalt projects; and
 
18    WHEREAS, The Department uses recycled asphalt shingles in
19its hot mix asphalt projects; and
 
20    WHEREAS, The Senate believes that for new applications and

1renewals of recyclers it is necessary for the Department to
2develop a protocol to ensure that only responsible recyclers
3operating under appropriate permits and Beneficial Use
4Determinations issued by the Illinois Environmental Protection
5Agency are providing materials to the Department for its use;
6therefore, be it
 
7    RESOLVED, BY THE SENATE OF THE NINETY-EIGHTH GENERAL
8ASSEMBLY OF THE STATE OF ILLINOIS, that we urge the Department
9not to approve the production of hot mixes from recycled
10asphalt shingles, and not to use recycled asphalt shingles from
11a recycler in its projects, until the Department has received
12from the Illinois Environmental Protection Agency a copy of the
13information the Agency collects from the recycler in order to
14conduct the prior experience evaluation required under Senate
15Bill 1925, if that bill is enacted into law; and be it further
 
16    RESOLVED, That we urge the Department to obtain
17verification from the recycler as to the accuracy and
18sufficiency of the information in the Beneficial Use
19Determination; and be it further
 
20    RESOLVED, That we urge the Department to review all
21verified information from the Illinois Environmental
22Protection Agency and the recycler in order to make a
23determination regarding the propriety of the recycler's

1production of material for use in hot mix asphalt projects; and
2we further urge the Department not to approve any recycler that
3has a pending or unresolved environmental compliance action in
4this State or any other against it or any of its principals;
5and be it further
 
6    RESOLVED, That we urge the Department, on an annual basis,
7to obtain verification, for each hot mix asphalt plant that
8used recycled asphalt shingles on Department projects during
9the previous calendar year, of the number of tons of recycled
10asphalt shingles used in Department contracts (by contract) and
11that the usage was in accordance with subsection (b) of Section
124-221 of the Illinois Highway Code; and we further urge the
13Department not to approve a hot mix asphalt plant for
14production in any calendar year prior to receiving that
15verification.
