SYNOPSIS AS INTRODUCED:
 
ILCON Art. I, Sec. 6

    Proposes to amend the Bill of Rights Article of the Illinois Constitution. Provides that the people shall have the right to be secure in their electronic communications and data against unreasonable searches, seizures, invasions of privacy or interceptions of communications by eavesdropping devices or other means. Provides that no warrant shall issue without probable cause, supported by affidavit particularly describing the data or communication to be accessed. Effective upon being declared adopted.

CONSTITUTIONAL AMENDMENT

 
3    RESOLVED, BY THE SENATE OF THE NINETY-EIGHTH GENERAL
4ASSEMBLY OF THE STATE OF ILLINOIS, THE HOUSE OF REPRESENTATIVES
5CONCURRING HEREIN, that there shall be submitted to the
6electors of the State for adoption or rejection at the general
7election next occurring at least 6 months after the adoption of
8this resolution a proposition to amend Article I of the
9Illinois Constitution by changing Section 6 as follows:

BILL OF RIGHTS

12    (ILCON Art. I, Sec. 6)
13SECTION 6. SEARCHES, SEIZURES, PRIVACY AND INTERCEPTIONS
14    The people shall have the right to be secure in their
15persons, houses, papers, electronic communications and data,
16and other possessions against unreasonable searches, seizures,
17invasions of privacy or interceptions of communications by
18eavesdropping devices or other means. No warrant shall issue
19without probable cause, supported by affidavit particularly
20describing the place to be searched and the persons or things
21to be seized, or the data or communication to be accessed.

SCHEDULE
2    This Constitutional Amendment takes effect upon being
3declared adopted in accordance with Section 7 of the Illinois
4Constitutional Amendment Act.
