SYNOPSIS AS INTRODUCED:

    Amends the Counties Code. Provides that on or before June 1, 2015, the county code and all ordinances and regulations adopted by the county board shall be provided by the county clerk to the Office of the State Comptroller in an electronic format designated by the Comptroller. Provides that beginning October 15, 2015, updated information shall be provided on a quarterly basis. Sets forth posting requirements and penalties for delinquent reporting. Makes conforming changes in the Township Code and the Illinois Municipal Code.

1    AN ACT concerning local government.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Counties Code is amended by changing Section
55-29007 as follows:
 
6    (55 ILCS 5/5-29007)  (from Ch. 34, par. 5-29007)
7    Sec. 5-29007. Public review and inspection; sale. The duly
8approved county code shall be made available for public review
9and inspection in the office of the county clerk. On or before
10June 1, 2015, the county code and all ordinances and
11regulations adopted by the county board shall be provided by
12the county clerk to the Office of the State Comptroller in an
13electronic format designated by the Comptroller. Upon
14receiving that information from a county clerk, the Comptroller
15shall post that information on his or her official website.
16Thereafter, beginning October 15, 2015, updated information
17shall be provided on a quarterly basis on or before the dates
18indicated: for the quarter ending September 30, October 15; for
19the quarter ending December 31, January 15; for the quarter
20ending March 31, April 15; and for the quarter ending June 30,
21July 15. If the information is not provided to the Comptroller
22on or before June 1, 2015 and on or before the due date for each
23quarter thereafter, the Comptroller may charge the county up to

1$5 per day for the first 15 days the information is past due,
2up to $10 per day for 16 through 30 days the information is
3past due, up to $15 per day for 31 through 45 days the
4information is past due, and up to $20 per day for the 46th day
5the information is past due and every day thereafter. All fees
6collected under this Section shall be deposited into the
7Comptroller's Administrative Fund.
8    The county board may authorize the county clerk to sell
9copies of the code to the public and may establish an
10appropriate fee for that purpose.

12    Section 10. The Township Code is amended by changing
13Section 75-10 as follows:
 
14    (60 ILCS 1/75-10)
15    Sec. 75-10. Township meeting records. The township clerk
16shall record in the book of records of the township the minutes
17of the proceedings of every township meeting held in the
18township and shall enter in the book every order or direction
19and all by-laws, rules, and regulations made by the electors at
20any township meeting. On or before June 1, 2015, the ordinances
21and resolutions adopted by the board of trustees of the
22township, together with every order or direction and all
23by-laws, rules, and regulations made by the electors, shall be
24provided by the township clerk to the Office of the State

1Comptroller in an electronic format designated by the
2Comptroller. Upon receiving that information from a township
3clerk, the Comptroller shall post that information on his or
4her official website. Thereafter, beginning October 15, 2015,

20    Section 15. The Illinois Municipal Code is amended by
21changing Section 1-2-5 as follows:

23    Sec. 1-2-5. The municipal clerk shall record, in a book
24used exclusively for that purpose, all ordinances passed by the

1corporate authorities. Immediately following each ordinance
2the municipal clerk shall make a memorandum of the date of the
3passage and of the publication or posting, where required, of
4the ordinance. This record and memorandum, or a certified copy
5thereof, shall be prima facie evidence of the contents,
6passage, and of the publication or posting of ordinances. On or
7before June 1, 2015, the municipal clerk shall make available
8to the Office of the State Comptroller a list of all ordinances
9and resolutions adopted by the corporate authorities in an
10electronic format designated by the Comptroller. Upon
11receiving that information from a municipal clerk, the
12Comptroller shall post that information on his or her official
13website. Thereafter, beginning October 15, 2015, updated
14information shall be provided on a quarterly basis on or before
15the dates indicated: for the quarter ending September 30,
16October 15; for the quarter ending December 31, January 15; for
17the quarter ending March 31, April 15; and for the quarter
18ending June 30, July 15. If the information is not provided to
19the Comptroller on or before June 1, 2015 and on or before the
20due date for each quarter thereafter, the Comptroller may
21charge the county up to $5 per day for the first 15 days the
