SYNOPSIS AS INTRODUCED:

105 ILCS 5/34-18.48 new

Amends the School Code. Provides that if a student athlete has not met practice requirements for a high school sport due to the student's involvement in military training, then a waiver to participate in play in the regular season for that sport may be granted by the school board. Sets forth the waiver process. Provides for immunity from any liability for a coach, athletic director, school, school board, and school district with respect to the granting of a waiver. Effective immediately.

A BILL FOR

AN ACT concerning education.

Be it enacted by the People of the State of Illinois, represented in the General Assembly:

Section 5. The School Code is amended by adding Sections 10-20.55 and 34-18.48 as follows:

Sec. 10-20.55. Military training athletic waiver. If a student athlete has not met practice requirements for a high school sport due to the student's involvement in military training, then a waiver to participate in play in the regular season for that sport may be granted by the school board. Under this waiver process, the student may apply for the waiver with his or her respective coach or athletic director, and the coach or athletic director shall review the waiver and make a recommendation to the school board on whether to grant or deny the waiver. Except for an act of willful or wanton misconduct, a coach, athletic director, school, school board, and school district shall have immunity from any liability, whether civil or criminal or that otherwise might result from the granting of a waiver, and the waiver shall acknowledge that fact.
