HOUSE RESOLUTION

 
2    WHEREAS, The Drycleaner Environmental Response Trust Fund
3Council has delegated many of its programmatic
4responsibilities under the Drycleaner Environmental Response
5Trust Fund Act, including the duty to receive and process
6license applications and the duty to receive and process
7claims, to a private company, Williams and Company Consulting,
8Inc.; and
 
9    WHEREAS, This delegation of programmatic duties
10potentially threatens the regulatory scheme established under
11the Drycleaner Environmental Response Trust Fund Act;
12therefore, be it
 
13    RESOLVED, BY THE HOUSE OF REPRESENTATIVES OF THE
14NINETY-EIGHTH GENERAL ASSEMBLY OF THE STATE OF ILLINOIS, that
15the Auditor General is directed pursuant to Sections 3-2 and
163-5 of the Illinois State Auditing Act to conduct a performance
17audit of the Drycleaner Environmental Response Trust Fund
18Council to ensure that Williams and Company Consulting is
19administering the Council's programmatic responsibilities in a
20manner that is consistent with the requirements of the
21Drycleaner Environmental Response Trust Fund Act and rules
22adopted under that Act; and be it further

1    RESOLVED, That the Auditor General investigate and report
2on the number of states that have a drycleaner environmental
3cleanup insurance system that is similar to the system overseen
4by the Council and administered by Williams and Company
5Consulting, Inc.; and be it further
 
6    RESOLVED, That the Auditor General investigate and report
7on how many states have privatized the operation of their
8drycleaner environmental cleanup insurance systems; and be it
9further
 
10    RESOLVED, That the Auditor General investigate and report
11on the number of drycleaners in Illinois whose participation in
12the State's drycleaner environmental cleanup insurance system
13has been terminated for noncompliance with the Drycleaner
14Environmental Response Trust Fund Act and rules adopted under
15that Act; and be it further
 
16    RESOLVED, That the Auditor General commence this audit as
17soon as possible and report the findings and recommendations
18upon completion in accordance with the Illinois State Auditing
19Act; and be it further
 
20    RESOLVED, That the Drycleaner Environmental Response Trust
21Fund Council and Williams and Company Consulting, Inc., shall
22provide all needed information that the Auditor General deems

1necessary; and be it further
 
2    RESOLVED, That copies of this resolution be delivered to
3the Auditor General and to each of the members of the
4Drycleaner Environmental Response Trust Fund Council.
