HOUSE JOINT RESOLUTION

WHEREAS, The State of Illinois seeks to support development that enhances agriculture, industry, public safety, and the overall economy of Illinois; and

WHEREAS, Levees protect against reoccurring flood damage and have the ability to block wide floodplains and displace floodwater; and

WHEREAS, Permitting processes should be straightforward and timely so that lawful and responsible economic growth can be feasibly accomplished while preserving the goal of this State to protect the people of Illinois from unmitigated flood damages caused by others; and

WHEREAS, State regulatory processes should consider the regulatory processes of federal agencies, especially the U.S. Army Corps of Engineers and the federal Emergency Management Agency, to minimize the burden of meeting conflicting technical requirements between agencies; therefore, be it

RESOLVED, BY THE HOUSE OF REPRESENTATIVES OF THE NINETY-EIGHTH GENERAL ASSEMBLY OF THE STATE OF ILLINOIS, THE SENATE CONCURRING HEREIN, that we urge the Illinois Department of Natural Resources to develop amendments to Part 3700 of Title 17 of the Illinois Administrative Code for consideration of the Joint Committee on Administrative Rules that:

(1) better define the flood risk associated with levee construction by adjusting the upper regulatory limit for a worst-case analysis to be the flood discharge with a 0.2% annual chance of exceedance (500-year frequency) for levees and floodwalls;

(2) create uniform technical policies, when applicable and appropriate, with those imposed by other regulatory agencies at the federal, State, and local levels; and

(3) create standards for responding to application submissions in a timely manner with identification of requirements for necessary submissions to demonstrate compliance with administrative rules; and be it further

RESOLVED, That a suitable copy of this resolution be delivered to the Director of Natural Resources.
