1    AN ACT concerning regulation.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Public Utilities Act is amended by changing
5the heading of Article XX and Sections 19-130, 20-101, 20-102,
6and 20-110 as follows:
 
7    (220 ILCS 5/19-130)
8    Sec. 19-130. Commission study and report. The Commission's
9Office of Retail Market Development shall prepare an annual
10report regarding the development of competitive retail natural
11gas markets in Illinois. The Office shall monitor existing
12competitive conditions in Illinois, identify barriers to
13retail competition for all customer classes, and actively
14explore and propose to the Commission and to the General
15Assembly solutions to overcome identified barriers. Solutions
16proposed by the Office to promote retail competition must also
17promote safe, reliable, and affordable natural gas service.
18    On or before October 1 of each year, beginning in 2015, the
19Director shall submit a report to the Commission, the General
20Assembly, and the Governor, that includes The report shall be
21approved by the Commission and be filed by July 1 of each odd
22year with the Joint Committee on Legislative Support Services
23of the General Assembly and the Governor and shall be publicly

1available. The report shall include, at a minimum, the
2following information:
3        (1) an analysis of the status and development of the
4    retail natural gas market in the State of Illinois; and
5        (2) a discussion of any identified barriers to the
6    development of competitive retail natural gas markets in
7    Illinois and proposed solutions to overcome identified
8    barriers; and
9        (3) any other information the Office Commission
10    considers significant in assessing the development of
11    natural gas markets in the State of Illinois.
12    To aid in preparation of its annual report, as well in its
13assessment of barriers to the development of competitive retail
14natural gas markets and proposed solutions to overcome those
15barriers, the Commission's Office of Retail Market Development
16shall gather input from all interested parties as well as from
17other bureaus within the Commission.

23    Sec. 20-101. This Article may be cited as the Consumer
24Retail Electric Competition Act of 2006.

3    Sec. 20-102. Findings and intent.
4    (a) Competitive A competitive wholesale electricity and
5natural gas markets market alone will not deliver the full
6benefits of competition to Illinois consumers. For Illinois
7consumers to receive products, prices, and terms tailored to
8meet their needs, a competitive wholesale markets electricity
9market must be closely linked to a competitive retail electric
10and competitive retail natural gas markets market.
11    (b) To date, as a result of the Electric Service Customer
12Choice and Rate Relief Law of 1997, thousands of large Illinois
13commercial and industrial consumers have experienced the
14benefits of a competitive retail electricity market.
15Alternative electric retail suppliers actively compete to
16supply electricity to large Illinois commercial and industrial
17consumers with attractive prices, terms, and conditions.
18    (c) A competitive retail electric market does not yet exist
19for residential and small commercial consumers. As a result,
20millions of residential and small commercial consumers in
21Illinois are faced with escalating heating and power bills and
22are unable to shop for alternatives to the rates demanded by
23the State's incumbent electric utilities.
24    (d) The General Assembly reiterates its findings from the
25Electric Service Customer Choice and Rate Relief Law of 1997

1that the Illinois Commerce Commission should promote the
2development of an effectively competitive retail electricity
3market that operates efficiently and benefits all Illinois
4consumers.
5    (e) The General Assembly also finds that consumers of
6retail natural gas would benefit from market opening solutions
7and competitive choices.

10    Sec. 20-110. Office of Retail Market Development. Within 90
11days after February 2, 2007 (the effective date of Public Act
1294-1095) this amendatory Act of the 94th General Assembly,
13subject to appropriation, the Commission shall establish an
14Office of Retail Market Development and employ on its staff a
15Director of Retail Market Development to oversee the Office.
16The Director shall have authority to employ or otherwise retain
17at least 2 professionals dedicated to the task of actively
18seeking out ways to promote retail competition in Illinois to
19benefit all Illinois consumers.
20    The Office shall actively seek input from all interested
21parties and shall develop a thorough understanding and critical
22analyses of the tools and techniques used to promote retail
23competition in other states.
24    The Office shall monitor existing competitive conditions
25in Illinois, identify barriers to retail competition for all

1customer classes, and actively explore and propose to the
2Commission and to the General Assembly solutions to overcome
3identified barriers. The Director may include municipal
4aggregation of customers and creating and designing customer
5choice programs as tools for retail market development.
6Solutions proposed by the Office to promote retail competition
7must also promote safe, reliable, and affordable electric and
8natural gas service.
9    On or before June 30 of each year, the Director shall
10submit a report to the Commission, the General Assembly, and
11the Governor, that details specific accomplishments achieved
12by the Office in the prior 12 months in promoting retail
13electric and retail natural gas competition and that suggests
14administrative and legislative action necessary to promote
15further improvements in retail electric competition.

17    Section 99. Effective date. This Act takes effect upon
18becoming law.
