SYNOPSIS AS INTRODUCED:
 
430 ILCS 65/14.1 new

    Amends the Firearm Owners Identification Card Act. Provides that a holder of a Firearm Owner's Identification Card which has expired, who is not ineligible for a Firearm Owner's Identification Card under the Act, and who has submitted the application and supporting documentation to the Department of State Police to renew the Firearm Owner's Identification Card, but has not received the renewed Firearm Owner's Identification Card within 30 days as prescribed by the Act is not criminally liable for any offense an element of which is not having a currently valid Firearm Owner's Identification Card. Provides that nothing in this provision shall be construed to permit a person to purchase or receive another firearm or ammunition that he or she does not currently possess by presenting to the seller or transferor of the firearm or ammunition an expired Firearm Owner's Identification Card. Effective immediately.

1    AN ACT concerning safety.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Firearm Owners Identification Card Act is
5amended by adding Section 14.1 as follows:
 
6    (430 ILCS 65/14.1 new)
7    Sec. 14.1. Renewal defense. A holder of a Firearm Owner's
8Identification Card which has expired, who is not ineligible
9for a Firearm Owner's Identification Card under this Act, and
10who has submitted the application and supporting documentation
11to the Department of State Police to renew the Firearm Owner's
12Identification Card, but has not received the renewed Firearm
13Owner's Identification Card within 30 days as prescribed by
14Section 5 of this Act is not criminally liable for any offense
15an element of which is not having a currently valid Firearm
16Owner's Identification Card. Nothing in this Section shall be
17construed to permit a person to purchase or receive another
18firearm or ammunition that he or she does not currently possess
19by presenting to the seller or transferor of the firearm or
20ammunition an expired Firearm Owner's Identification Card.
 
21    Section 99. Effective date. This Act takes effect upon
22becoming law.
