SYNOPSIS AS INTRODUCED:
 
215 ILCS 5/370b.1 new

    Amends the Illinois Insurance Code. Provides that a group health plan and a health insurance issuer offering group or individual health insurance coverage may not discriminate with respect to participation under the plan or coverage against any health care provider who is acting within the scope of that provider's license or certification under applicable State law. Provides that group health plans and health insurance issuers may not refuse to accept certain types of providers into a network solely on the basis of their type of licensure. Provides that nothing in the provision concerning nondiscrimination in health care shall be construed as preventing a group health plan, a health insurance issuer, or the Department of Insurance from establishing varying reimbursement rates based on quality or performance measures.

1    AN ACT concerning regulation.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Illinois Insurance Code is amended by adding
5Section 370b.1 as follows:
 
6    (215 ILCS 5/370b.1 new)
7    Sec. 370b.1. Nondiscrimination in health care. A group
8health plan and a health insurance issuer offering group or
9individual health insurance coverage may not discriminate with
10respect to participation under the plan or coverage against any
11health care provider who is acting within the scope of that
12provider's license or certification under applicable State
13law. Group health plans and health insurance issuers may not
14refuse to accept certain types of providers into a network
15solely on the basis of their type of licensure. Nothing in this
16Section shall be construed as preventing a group health plan, a
17health insurance issuer, or the Department from establishing
18varying reimbursement rates based on quality or performance
19measures.
