SYNOPSIS AS INTRODUCED:

    Amends the Family Practice Residency Act. Makes changes concerning the purpose of the Act. Provides that the Department of Public Health shall have the power and duty to establish programs (instead of a program) for the repayment of the educational loans of primary care physicians and other health care providers within specialties determined to be eligible by the U.S. Health Resources and Services Administration for the National Health Service Corps Loan Repayment Program (instead of just the loans of primary care physicians) who agree to serve in designated shortage areas. Removes a provision setting forth the maximum annual payment that may be made to an individual. Allows the Department to use tobacco settlement recovery funding or other available funding to implement the programs. Effective immediately.

1    AN ACT concerning education.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Family Practice Residency Act is amended by
5changing Sections 2, 3, and 4.10 and by adding Section 3.09 as
6follows:

8    Sec. 2. The purpose of this Act is to establish programs a
9program in the Illinois Department of Public Health to upgrade
10primary health care services for all citizens of the State, to
11increase access, and to reduce health care disparities by
12providing grants to family practice and preventive medicine
13residency programs, scholarships to medical students, and a
14loan repayment program for physicians and other eligible
15primary care providers who will agree to practice in areas of
16the State demonstrating the greatest need for more professional
17medical care. The programs program shall encourage family
18practice physicians and other eligible primary care providers
19to locate in areas where health manpower shortages exist and to
20increase the total number of family practice physicians and
21other eligible primary care providers in the State.

2    Sec. 3. The terms specified in the following Sections 3.01
3through 3.08 have the meanings ascribed to them in those
4Sections unless the context of this Act otherwise requires.

7    Sec. 3.09. Eligible primary care providers. "Eligible
8primary care providers" means health care providers within
9specialties determined to be eligible by the U.S. Health
10Resources and Services Administration for the National Health
11Service Corps Loan Repayment Program.

13    Sec. 4.10. To establish programs a program, and the
14criteria for such programs program, for the repayment of the
15educational loans of primary care physicians and other eligible
16primary care providers who agree to serve in Designated
17Shortage Areas for a specified period of time, no less than 2
18years. Payments under this program may be made for the
19principal, interest and related expenses of government and
20commercial loans received by the individual for tuition
21expenses, and all other reasonable educational expenses
22incurred by the individual. The maximum annual payment which
23may be made to an individual under this law is $20,000, or 25%
24of the total covered educational indebtedness as provided in

1this Section, whichever is less. Payments made under this
2provision shall be exempt from Illinois State Income Tax. The
3Department may use tobacco settlement recovery funding or other
4available funding to implement this Section.
