SYNOPSIS AS INTRODUCED:

40 ILCS 5/3-148.5 new
40 ILCS 5/4-139.5 new

Amends the Downstate Police and Firefighter Articles of the Illinois Pension Code. Provide that the municipality is entitled to appear, as a matter of right, in any proceeding involving a participant or a beneficiary that might result in a final administrative decision by the board. Effective immediately.

AN ACT in relation to public employee benefits.

Be it enacted by the People of the State of Illinois, represented in the General Assembly:

Section 5. The Illinois Pension Code is amended by adding Sections 3-148.5 and 4-139.5 as follows:

(40 ILCS 5/3-148.5 new)

Sec. 3-148.5. Right of employer to intervene. If not otherwise a party, the municipality is entitled to appear, as a matter of right, in any proceeding involving a participant or a beneficiary under this Article that might result in a final administrative decision by the board.

Sec. 4-139.5. Right of employer to intervene. If not otherwise a party, the municipality is entitled to appear, as a matter of right, in any proceeding involving a participant or a beneficiary under this Article that might result in a final administrative decision by the board.

Section 99. Effective date. This Act takes effect upon becoming law.
