SYNOPSIS AS INTRODUCED:

New Act

Creates the Real Property Stakeholder Arson Investigation Authorization Act. Provides that any person or legal entity having an interest in real property may file an affidavit with the sheriff or local law enforcement agency where the property is located authorizing the sheriff or local law enforcement agency to file a complaint on his or her behalf for any arson committed on the property.

A BILL FOR

AN ACT concerning property.

Be it enacted by the People of the State of Illinois, represented in the General Assembly:

Section 1. Short title. This Act may be cited as the Real Property Stakeholder Arson Investigation Authorization Act.

Section 5. Authorization to file and investigate arson complaints.

(a) The owner or agent of an owner, mortgagee or agent of a mortgagee, lienholder or agent of a lienholder, or holder of a beneficial interest or agent of a holder of a beneficial interest in any real property in this State may file an affidavit to authorize the sheriff or local law enforcement agency where the real property is located to file a complaint on his her behalf for any arson that may be committed on his or her real property.

(b) The affidavit shall be filed with:

(1) the sheriff of the county where the property is located if in an unincorporated area of the county; or

(2) with the local law enforcement agency where the property is located if in an incorporated area of the county.

(c) The affidavit shall include the address of the property and the address of the owner or agent of the owner, the mortgagee or agent of the mortgagee, the lienholder or agent of the lienholder, or the holder of a beneficial interest or agent of the holder of a beneficial interest in the real property.
